WITNES SETT H: That in consideration of the sum of One Dollar($1.00) and other good and valuable consideration in hand paid by the City, Ryan does hereby grant and convey unto City, its successors and ,assi ns perpetual non-exclusive easement for drainage and utility purposes under, � over and across the following described property in Ramsey County,Minnesota: A 20 foot wide Drainage and Utility Easement over, under and across that part of Lots 1 and 2, Bloch 3, CENTRE POINTE BUSINESS PARK, according to the recorded P lat thererof, Ramsey County, Minnesota, the centerline described as follows+ Commencing at the northeast comer of said Lot 1; thence South 00 degrees 00 minutes 00 seconds East, assumed bearing, along the east line of said Lot 1, a distance of 348.53 feet to the beginning of the centerline to be described; thence South 45 degrees oo minutes oo seconds west, a distance of 133.16 feet; thence Noah 45 degrees 25 minutes 48 seconds West, distance of 151.20 feet; thence South 49 degrees 49 minutes 25 seconds west, a distance of 158.53 feet; thence Forth 89 degrees minutes 20 seconds west, a distance of 5 6.3 3 feet to the west line of said Lot 2 and said centerline there terminating. The sidelines of said easement are to be prolonged or shortened to terminate at said east line of Lot X and said west line of Lot 2. which eascrnent shall include the perpetual rights of said City, its successors or assigns,to construct, maintain operate and repair any drainage and utility lines under,over and across the strip of land hereinbefore described,together with a non-exclusive perpetual easement for ingress and egress over the above described property, all without additional compensation. City will indemnify, save, defend and hold Ryan, its successors and assigns, from any and all claims b y any person for an y personal injury or property damage,made as a result of the use of any drainage and utility lines or easement which is the subject of this Easement. This indemnification shall not include claims made due to the negligent acts of any Ryan employee, agent or servant.
