REQUEST FOR COUNCIL ACTION <br /> DATE:E. 2/23/98 <br /> ITEM NO.: J-1 <br /> Department Approval-Do Manager Reviewed Agenda Sectlonl.m <br /> U, I 7:�!Q <br /> Item Descrl'ptionmb Right-of-Way Management ement Ordinance <br /> ]Background: At the September and November work sessions, the Council reviewed a model <br /> right-of-waxy ordinance prepared by the League of Minnesota Cities which conforms to recent <br /> federal and state legislation. The current draft of the ordinance was read by the Council on <br /> December 83 1997 and January 26, 1998. <br /> The Minnesota legislature required that the Minnesota Public Utilities Commission(MPUC) <br /> adopt rules to standardize marry of the aspects of right-of-way management. The current draft of <br /> the ordinance is based on a model prepared by the League of Minnesota Cities. Recently, as a <br /> result of work with the MPUC rule making process, the League of Minnesota Cities has issued a <br /> new draft of the right-of-way ordinance which is significantly different than the one which our <br /> proposed sed ordinance is based. The new model ordinance is more closely aligned with expected <br /> NWUC rules, The new model ordinance is currently being reviewed by the City Attorneys office <br /> and has not been revised for the City of Roseville. <br /> In order to allow adequate time for legal review, it is recommended that the Council continue the <br /> final adoption of this ordinance to the March 10, 1 998 City Council meeting. <br /> Motion continuing the adoption of a new right-of way management ordinance to March 10, 1998. <br /> Prepared by* Karl P.
