Regular City Council Meeting <br /> Monday, September 12, 2011 <br /> Page 6 <br /> Chief Mathwig responded that, from his perspective, the existing pawn broker in <br /> the City was beyond qualified and had been more than cooperative with the Police <br /> Department. <br /> City Attorney Bartholdi opined that the proposed language would in no way hind- <br /> er the City from considering a new application or denial for reasonable cause, <br /> while providing existing license holders some preference. Mr. Bartholdi advised <br /> that there were constitutional issues in limiting a prospective location; and that <br /> additional discussions and further modifications may be indicated following addi- <br /> tional discussions and research among the City's Community Development De- <br /> partment staff and the City Attorney's office. <br /> Councilmembers McGehee and Johnson expressed their individual appreciation <br /> for staff's time and research in bringing this recommendation forward. <br /> Mayor Roe called for public comment; however, no one appeared to speak for or <br /> against. <br /> Mayor Roe concurred that further discussion on how to address pawn shops in the <br /> City's Zoning Code was warranted; and asked that staff look at other types of <br /> similar businesses during that next step in this process. <br /> Johnson moved, Willmus seconded, enactment of Ordinance No. 1414 (At- <br /> tachment A) entitled, "An Ordinance Amending Title Three, Section 311.03, to <br /> Limit the Number of Pawn Broker Licenses in the City." <br /> Roll Call <br /> Ayes: Willmus; Pust; McGehee; Johnson; and Roe. <br /> Nays: None. <br /> b. Consider a Resolution Adopting the Twin Lakes Sub-Area I Regulating Plan <br /> and Consider an Ordinance (and Ordinance Summary) Amending Section <br /> 1005.07 to Incorporate the Twin Lakes Sub Area I Regulating Plan <br /> Community Development Director Patrick Trudgeon and City Planner Thomas <br /> Paschke were available for this presentation. <br /> Community Development Director Patrick Trudgeon briefly summarized the con- <br /> text for the proposed Regulating Plan and staff's recommendation for this impor- <br /> tant document, as detailed in the RCA dated September 12, 201; and specifically <br /> in Sections 1.2 and 1.3 of the RCA. Mr. Trudgeon reviewed mitigation efforts as <br /> further outlined in the RCA, as well as incorporation of suggestions provided dur- <br /> ing previous discussions with the City Council and the public, both at the Plan- <br /> ning Commission and City Council levels. <br />
