2. The City's Comprehensive Plan text does not specifically address this parcel; <br /> however, it is the policy of the City to discourage the encroachment of <br /> commercial uses into residential neighborhoods. The transfer of the west .54 <br /> acres of the parcel to the adjacent parcel, along with the designation of the <br /> .54 acres as high density residential and the rezoning of the parcel to R3A, <br /> will remove the commercial encroachment into a residential area. <br /> 3. A minor subdivision to transfer this property from 2075 Snelling Avenue <br /> North (McDonald's - land owned by applicant) to 2096 Fry Street North (four- <br /> plexes - land awned by applicant) was approved by the City Council on <br /> September 8, 1997, subject to approval of a comprehensive plan <br /> amendment and rezoning of the parcel. <br /> 4. The proposed comprehensive plan amendment is in harmony with the <br /> general purpose and intent of the City's Comprehensive Plan and Title 10 of <br /> the city Code (Zoning). <br /> 5. The proposed comprehensive plan amendment will not adversely affect the <br /> public health, safety, or general welfare, <br /> STAFF RECOMIMENDATION <br /> 4.1 used on the findings outlined in section 3.1 of this report, staff recommends <br /> approval of the request for a comprehensive plan amendment to change the <br /> designation of the crest .54 acre of the parcel located at 2075 Snelling Avenue <br /> North from Business to High Density Residential, and re-affirmation of the minor <br /> subdivision with the following provisions: <br /> 1. A 20 foot wide private utility easement for water service must be dedicated <br /> ®in the appropriate ro riate location within the.54 acre parcel being transferred. <br /> 2. A 20 foot wide access easement for public safety protection must be <br /> dedicated through the McDon ald's parking lot in a location approved by the <br /> city. <br /> + ING CQfflMl IO A <br /> 5.1 On December 10, 1997, the Planning Commission held a public hearing on the <br /> request. Steve Halverson (NIPS, Inca and Craig Barnes(McDonald's)were present <br /> to answer questions and provide additional information. No residents present <br /> commented on this request. <br /> 5.2 The Planning commission discussed the future use of the .54 acres (comparable <br /> to existing four-plexes, although no plans have been finalized) and the apparent use <br /> of the off-street parking area of the apartments for vehicle storage. <br /> RCA(PF# 958) -01/12198-Page 8 of 4 <br />
