4.0 STAFF RECOMMENDATION 4.1 Based on the findings outline in Section 3.1, staff recommends approval of the request for a variance to reduce the side yard setback to four feet and the rear yard setback to three feet for the purpose of constructing an attached two car garage at 2416 Lexington Avenue N, with the following provisions: I. The driveway mint be hard-surfaced in conjunction with construction of the garage in accordance with Section 703-04(B)(7) of the City Code 2. A vehicle turnaround area must be constructed in accordance with Section 70 .04{B (I o) of the City code, since Lexington Avenue is a County roadway. If this area provides a turnaround/parking area for more than two vehicles, screening from Lexington Avenue must be installed. pLAN ING CQALMISSION-AC N On December 10, 1 997, the Planning Commission held a public hearing on the nest. Frederick Chute was present to answer questions estions and provide additional information. A letter was received from Sari El harif, propel owner to the north, opposing the construction of any garage on this property. All property owners within 350 feet of the project were notified in accordance with State Statute and City policy. No other residents commented at the public hearing or contacted city staff regarding this regeust. 5.2 The Planning Commission discussed the location of an existing fence on the north side of the ro ert and the screening provided, the age of the hone, and the p p hardships for granting a variance 5.3 y a 5-0 vote, the Planning omission recommended that the City Council grant a variance to reduce the side yard setback to four feet and the rear yard setback to three feet for the p urpose of constructing an attached two car garage at 241 Lexington Avenue, based on the findings outlined in Section 3.1 of this report and with the provisions outlined in Section 4.1 of this report.
