fV <br /> The City shall have the following duties, tesponsibilities and authority with respect <br /> to the administration of the Plan: <br /> (a) To construe and interpret the Plan, and decide all questions of eligibility; <br /> (b) To prescribe procedures to be followed by Participants in malcin <br /> p elections <br /> under the Plan and in f Ping claims under the Plan; <br /> c To prepare and distribute information lainin the Plan to Participants; <br /> . <br /> � �. �c�pants; <br /> (d) To provide such information to Participants as shall be necessary <br /> * p ary for the <br /> proper stration of the Plan; <br /> (e) To furnish the Participant such annual reports with respect to <br /> � the administra. <br /> tion of the Plan as are reasonable and appropriate; <br /> p <br /> To keep reports of elections, cl , and disbursements for claims under the <br /> Plan; <br /> (9) To employ such persons, including, but not limited to actuarie <br /> accountants, <br /> and counsel, as it deems appropriate to perform such duties as ma y from <br /> time <br /> to time be required under ERISA and to render advice upon request with <br /> p � <br /> regard to any natters arising under the Plana <br /> (h) To purchase any insurance deemed necessary for providing Benefits un der this <br /> Plan; <br /> (1) To accept, modify or reject elections under the Plan; <br /> To prepare and file any reports or returns with respect to the Plan an required <br /> by applicable law; - <br /> (k) To modify, alter, amend, or terminate this Plan; <br /> (1) To take all other steps deemed necessary to properly administer ' <br /> with � p p y - the Plan �n <br /> accordance with its terms and the requirements of applicable law. <br /> pp <br /> 10-02 Rules and Decisions <br /> The City shall interpret the Plan and decide an matters arisen under it y and may <br /> adopt such rules and procedures that it deem necessary, or appropriate perate rn the <br /> "stration of the Plan* M rules and decisions of the shall <br /> ty be uniformly and <br /> consistently applied to all Participants in similar circumstances and shall be ' <br /> conclusive and <br /> 20 <br />
