REQUEST FOR COUNCIL ACTION DATE: 12-13*`9 3 N.: ITEM NOOO Department Approval* Manager Reviewed: Agenda Section: Rearing Item Description: Robert Levine/Palisades Limited Partnership request, for vacation of right-of-way and drainage and utility easements at 535, 550, 565, and 570 Sandhurst Drive. BACKGROUND Palisades Limited Partnership, the owner of palisades Apartment project on Sandhurst Drive, have made a request to the City for the vacation of certain utility and drainage easements and public right-of-way within the apartment property. 2 , The purpose of the request is to clear up certain title defects where encroachments to these easements exist. In all, there are 11 areas within the project where encroachments must be addressed. 3411, The Engineering staff has reviewed these and found all but one to be appropriate for vacation proceedings as presented by the applicant} - The one area where they have concern Ynvolve!� an encroachment of a building to a City maintained sanitary sewer main. Due to the depth of the main, it is Engineering' s feeling that if the City needed to replace or repair the line at this location, there would be an additional expense involved to protect the building from any damage due to excavation. With this in mind, the City's legal Council has prepared an agreement whereby present or future owners of the Palisades Apartment would pay for any additional expense required to protect the footings and the wall of the building at 550 Sandhurst Drive should work in that area be necessary. This agreement, once signed by the owner and by the City. of Roseville would be recorded at the Ramsey County recorder's office* With this agreement in place, the Engineering Department is comfortable with the proposed vacation of easements for this project. 2 , The planning Commission, at their December 9. 1993 meeting, considered this request. Because of the change in the meeting date of the planning Commission meeting, the motion on this application will be presented at the December 13 , 1993 City Council meeting.
