REQUEST FOR COUNCIL ACTION DATE: 11-22-93
ITEM NO, .
Department Approval: Manager Reviewed: Agenda section:
Consent
Item Description: George and Judith palke request for a minor
variance at 1775 Shorewood Curve.
Background:
.110. For purposes of continuity, ;when dealing with corner lots
having frontage on two public streets, the Roseville zoning
ordinance defines the front yard as that side of the lot that
has the narrowest street frontage* Rear yard and side yard
setbacks then, are determined by this technical definition.
The Palke's home, at 1775 Shorew ood Curve, is located in the
northwest corner of Wheeler St. and Shorewood Curve, It has 95
feet of frontage on Shorewood Curve and 180 .feet of frontage on
Wheeler Street. By definition them, Shorewood Curve is the
front yard of this lot. The house, however, is oriented toward
Wheeler St, and setbacks were figured based on Wheeler street
frontage. This means that was is technically a rear yard
setback area has been treated as a side yard setback area and
vice versa ghat is technically a side yard setback area has
been used as the rear yard+
3 The PalkeIs are proposing an addition to the house that would
include a new porch and spa area, together with a deck
extending from the northeast corner of their home. The design
of the addition was based on the north property line being the
side yard and the east property line being the rear yard. With
that configuration, no variances would have been required.
However, with the technical definition of the lot, a rear yard
setback variance would be required for this addition to be
built.
4 In reviewing this application for a variance, -the Minor
Variance Committee considered other factors than the location
and orientation of the house on the lot. Specifically, the
Committee noted that the topography of the lot drops off to the
north and east making it Jiff icult to move the addition further
away from the north property lines In addition, moving the
project to the east would cover existing kitchen windows and
would preclude an access door to the addition. Moving the
addition would also necessitate modifying the roof line for the
design. Based on these hardships, the Minor variance 'Committee
unanimously recommended approval of a 17 foot rear yard setback
.•
