<br />35-W and lying southwesterly of the foJJowing described line: <br /> <br />Commencing at the intersection of the south line of the <br />above described property and the easterly right-of-way <br />line of Interstate Highway 35-W; thence easterly along the <br />south line of said property a distance of 6.41 feet to the <br />point of beginning of said line; thence northwesterly 50.28 <br />feet, more or less, to a point on the easterly right-of-way <br />line of said highway and there terminating, said point <br />being 48.61 feet northwesterly of the south line of said <br />property, as measured along said right-of-way line. <br /> <br />Together with a temporary construction easement described as <br />foJJows: <br /> <br />A strip of land 20 feet in width easterly of and adjoining <br />the above described strip of land and easterly of and <br />adjoining the easterly right-of-way line of Interstate <br />Highway 35-W. <br /> <br />Name <br /> <br />Nature of Interest <br /> <br />Thomas M. That none of the land hereindescribed is devoted to a public use. <br /> <br />WHEREFORE, petitioner prays for an order and decree of this Court: <br /> <br />1. Taking title in fee to Parcels I, 2, 3, 4, 5, 7, 8, and 9, as set forth <br /> <br />above. <br /> <br />2. Taking, appropriating and condemning permanent and temporary <br /> <br />easements for the purpose of constructing, maintaining, and operating under- <br /> <br />ground utili ty mains, pipes, and appurtenances, a public roadway, and bridge <br /> <br />above, over, across, and under certain lands hereinafter described, together with <br /> <br />ingress and egress. <br /> <br />3. That it be adjudged and determined that the use for which such land <br /> <br />is sought to be taken is for a public use and that this taking is authorized by law. <br /> <br />4. That three competent and disinterested persons, residents of Ramsey <br /> <br />County, Minnesota, be appointed as commissioners to ascertain and report the <br /> <br />amount of damages that wiH be sustained by the owners; that the Court order <br /> <br />-11- <br />
