<br />.;JI <br /> <br />maintaining, and operating underground utility mains, pipes, and appurtenances, a <br /> <br />public roadway, and bridge, together with ingress and egress. <br /> <br />3. Petitioner is authorized by law, pursuant to M.S.A. Section 465.01 to <br /> <br />exercise the right of eminent domain as provided by M.S.A. Chapter 117, to <br /> <br />acquire certain real property and interest hereinafter described. <br /> <br />4. The legal descriptions of the properties, the nature of the interest <br /> <br />sought, and the names of all persons or entities with interest in said property <br /> <br />appearing of record are as follows: <br /> <br />PARCEL I: Fee title to a strip of land over, under, and across the <br /> <br />following described property: <br /> <br />The east four hundred seven (E. 407) feet of the west six hundred <br />twenty-seven (W. 627) feet of the east three-fourths (E. 3/4) of the <br />north one-half (N. 1/2) of the Southeast Quarter (S.E. 1/4) except the <br />south fifty (S. 50) rods thereof, all in Section eight (8), Township <br />twenty-nine (29), Range twenty-three (23), according to the Govern- <br />ment survey thereof, and subject to easements of record; excepting <br />the northerly thirty-five (N. 35) feet of the Easterly 27.4 feet of the <br />above described premises. <br /> <br />Said strip of land being all that part of the above described property <br />lying easterly of and adjoining the following described line: <br /> <br />Commencing at a point on the east line of the above <br />described property, said point being thirty-five (35) feet <br />south of the north line of the Southeast Quarter of said <br />Section 8; thence westerly along a line parallel with said <br />north line a distance of 5.00 feet to the point of beginning <br />of said line; thence southerly a distance of 105.15 feet, <br />more or less, to a point on the east line of said property <br />and there terminating, said point being 105.00 feet <br />southerly of the point of commencement. <br /> <br />Together with a temporary construction easement described as <br />follows: <br /> <br />The north 125.00 feet of the east 20.00 feet of the above <br />described property lying westerly of and adjoining the <br />above described strip of land. <br /> <br />Name <br /> <br />Nature of Interest <br /> <br />Roberts Construction, Inc. <br /> <br />Owner <br /> <br />-2- <br />
