.IIU
permit was intended for the family room addition, between the
house and the free- standing garage.
5:a, Based on his belief that he could expand his hone toward the
lake, as long as he did not cross the vertical plane of the at
grade deck closest to the lake, fir. Kadrie began construction
of the kitchen addition. ' In July, 1993, Building inspection
staff noticed the construction and stopped it until the issue
of valid building permits and shoreline setbacks could be
resolved (building permits are valid for one year) .
6W Staff's interpretation of the shoreline management ordinance
would allow Mr. Kadrie to extend his kitchen only to the limits
of the existing first floor deck. It is staff's feeling that
extending a new deck beyond this point should be interpreted as
increasing a substandard dimension and therefore,, is prohibited
by ordinance. Staff further interprets the code to limit
further enroachment on the lower level beyond the existing
structural wall (the at grade deck is net considered to be an
integral structural element) . Mr. adrie's view is that the
limits of the lower at grade deck established that point beyond
which substandard dimensions cannot be allowed and is asked the
Council, as the Board of Zoning Appeal, for an interpretation
on this matter. At their meeting of August 23, 1993, the City
Council interpreted the provisions of Section 18 of the
Roseville zoning code (Shoreland Management ordinance) in a
manner that defines the structural wall of the house as that
point beyond which construction could not occur without first
applying for a variance.
7 10, The Planning commission, 'on a 5-1 vote, moved to recommend
approval of a 10 foot 6 inch variance to the shoreland
management ordinance for the Kad ie kitchen expansion and to
recommend denial of a variance for a deck that would extend
closer to the lake then the kitchen addition.
Policy objectives:
16 To protect the natural ecology and aesthetic environment of the
community through the wise development of shorelands of public
waters.
Staff Recommendation
10 It is recommended that the City Council approve a 10 Foot 6
inch variance to the Shoreland Management Ordinance for the
adrie kitchen expansion and to deny the variance request for
the proposed deck that mould extend closer to the lake than the
kitchen addition. It is further recommended that the code be
interpreted to limit Further encroachment on the lower level
beyond the existing structural wall of the house. A building
permit for this addition needs to be applied For prior to any
further work being completed.
