REQUEST FOR COIINCIL ACTION DATE: 4/26/93 <br />Department AA*roval : manager Reviewed: <br />ITEM KOs : go. 1( <br />Agenda section <br />Reports and Recommendations <br />item 'Dose -ription: Receipt of petition for construction of Arthur Street <br />north of County Road C and storm water pond <br />construction <br />Background es On April 22, 1993, staff received petitions from the Ryan <br />Development group requesting consideration for the construction of <br />Arthur Street north of County Road C and a storm water holding pond to <br />service this area. The petition is being submitted requesting the <br />project proceed without a public hearingj, Since the developer owns 100% <br />of the potentially assessable property. <br />Since it is being submitted as a loot petition, - the assumption is made <br />by staff that the project can proceed without a public hearing. All <br />costs for the project will be assessed against Ryan Development. <br />policy objectivese. By city policy and state itprovement statute,, for <br />the project to proceed the douncil must receive the petition and order <br />the preparation of a feasibility report.. Once the feasibility report <br />has been prepared, the council can consider the report and order the <br />project. The project can be ordered following approval of-the <br />feasibility report without a public hewing if the petitioner waives the <br />right to a hearing and agrees to pay all project costs. The next step <br />would be to complete the feasibility report and return to the council <br />for-consideration for ordering the project. <br />Financial implications: project costs for the proposed improvements <br />will be- detailed in the feasibility reports We anticipate the report <br />will take 45 days to complete and should be available for oonsideration <br />by the council in early June. Assuming the project is ordered at the <br />June 14, 1993, meeting, plans will be completed in approximately six <br />weeks and bids received in late July or early August. The project could <br />start in late August, and the first portion, including rough grading and <br />preliminary paving, could be completed by November 1, 1993, assuming <br />ideal weather conditions* <br />Staff recommendation: Staff recommends the petition be received and a <br />feasibility report prepared. Because of the current staff workload, <br />the report must be contracted out to a consulting engineer. We suggest <br />that the petition be accepted and the report ordered with the <br />understanding that if the proj <br />
