Request for a Business <br />License at the pet Food Warehouse, 2575 Fairview Avenue <br />North. <br />Dr. Joel Lockett has requested a business license on behalf of <br />Animal Medical Clinic P.A. to operate veterinary services at the <br />Pet Food Warehouse facility at 2575 Fairview Avenue N. Dr. <br />Lockett is proposing to offer the following veterinary services <br />at the site in question which would include routine checkups, <br />wellness testing (stool, heartworm, leukemia tests) , <br />inoculations, and minor treatment. There would be no surgery or <br />animal boarding on the site. All disposables would be removed <br />from the site and handled at their permanent facility at 2603 <br />Hennepin Avenue South. <br />These services will be provided at affokdable rates. The <br />services will be conducted inside the building every Saturday* <br />They will setup portable screens and folding exam tables in the <br />rear of the store* Dr. Lockett will be present at the Work <br />Session on April 19, 1993 to provide further information. <br />The Pet Food Warehouse site is coned 8�, general business. The <br />Ba--3 zoning district regulations • allow pet shops and animal <br />hospitals as a permitted use in that zoning district* No <br />distinction is made between permanent or accessory - veterinary <br />clinics. The City's license regulations found in Section 14.010, <br />paragraph 3, requires a license for animal veterinary services <br />and Animal Medical Clinic P.A. has applied for the appropriate <br />license. Based on these findings, 1 would conclude that the <br />current City regulations allow Animal Medical Clinic P.A. to <br />operate at the site and the appropriate license could be <br />granted. <br />I understand that there has been some concerns expressed because <br />of the "temporary or accessory" nature of the propo sal . I have <br />discussed this matter with Roger Jensen to ste what alternatives <br />are possible. Roger Jensen has indicated "although the City <br />certainly wants its permanent businesses to thrive, the City <br />cannot legally regulate competition for -that purpose. Any <br />regulation must be premised on good land use criteria or health <br />and safety matters'. -Roger Jensen has prepared the attached <br />ordinance for City Council consideration. The proposed ordinance <br />clarifies the licensing provisions to indicate that licenses will <br />be is sued -only if they are conducted in the principle structure <br />and that there are permanent examination and treatment facilities <br />provided.
