Item Description: Acceptance of Eldridge Avenue west ' of Fairview Avenue
as city road and utilities for public ownership and
maintenance
Background: Recently, construction of Eldridge Avenue west of Fairview
Avenue was completed. The work . was done in conjunction with the
redeVel opment of the corpus Christi site. A summary of the project is
attached from the project engineer, Mr. Dennis Brown.. The work included
the construction of sanitary sewer, watermain, storm sewer, and a
residential cul -de -sac street. The letter from the engineer indicates
that the work has been completed in accordance with the plans and
specifications and is ready for acceptance as public facilities. Also,
we have received a letter from Corpus Christi requesting that the public
ownership and maintenance begin.
Policy obj e c tive s e. Developers have two options when proposing new
developments within the-city: ".
1._ petition the city to have -the project constructed by the city's
contractor with costs assessed to them
2. Dire construction done for the project as per approved plans
and specifications by the City of Roseville.
City staff must make final inspection to assure that construction was
completed in compliance with city standards. If work is adequate, the
city then accepts the project and assumes maintenance for the new
facilities. This process has been completed for this improvement.
Financial implications: Work such as the Eldridge Avenue project
generally has no major financial implications for the city because:
1 Developer chose to construct the project and finance all
construction costs
2a All project costs were paid loot by the developer.
However, in this case, there were minor costs paid by the city for
backyard drainage improvements along the common lot line between
Eldridge and Skillman as a result of previously existing backyard
drainage problems. The city has agreed to finance minor regrading and
engineering costs from storm utility funds.

commendation: Since the project was constructed according to
city standards and a letter has been received from the engineer along

Reports and Recommendations
Item Description: Amending assessment roll, St. Rose of Lima appeal,
City project p -49 15, P- 91w--0 3p P-91-02-57,
Background: Last September, the City Council adopted resolutions
accepting assessment -rolls for the above listed projects* At that time,
assessments were levied against St. Rose of Lima Church for all
frontages in the full amounts recommended a The total amount of the
assessments was being slightly less than $72,000. During the time the
assessment roll was considered, St. Rose -filed a written objection to
the assessment and indicated they would appeal unless the. assessments
were reduced. Subsequent discussions were not able to resolve the
utter, and the assessment roll was adopted as presented.
Later action by attorneys for St. Rose resulted in a formal notice of
assessment appeal being filed with the district court Since that date,
our attorney has be6n negotiating with legal counsel for St. Rose in an
attempt to reach an out of court settlement. A tentative, settlement has
been reached and is presented to the council for its consideration •
Policy objectives: Assessments for the projects were levied in ,
accordance with City of Roseville assessment policy. used on advice
from the city's appraiser and attorney, it appears that the assessments
as proposed originally may exceed the benefit. Accordingly, it is
appropriate to consider possible reductions of the assessment amounts.
Financial implications -0 The atta Y:d resolution shows the original
amount of assessment. The proposed settlement figure of 4 7 , 7 5 5 . S 9
reprleser° s a reduction of $24,210.. The attached fact sheet prepared by
public wi Mks staff lists the original assessment amounts for the various
project components and the offer which has been accepted by both sides.
If the council concurs with the recommended settlement, the assessment
for Skillman Avenue r a Municipal State Aid project, will be completely
eliminated, and the assessments for Haml ine Avenue reduced by
appro 1mately $14,000m Reduced assessments will be financed by in-house
Municipal State Aid funds and additional PMP bond funds.
Page 2
Assessment appeal
3/8/93
Staff recommendation es Based on the advice of our attorney and
appraiser, we believe the settlement proposed is reasonable. St. Rose
has agreed to pay approximately $42,,000 in street assessments plus the
$5,773 driveway charge. This figure represents ghat we feel would be
the maximum amount which we could recover through an assessment appeal
trial. Therefore, it appears to he a reasonable settlement.

item ascription: Amending assessment Droll for Terrace Drive
improvement, for former Lincoln Development
parcels, city project 92-04
Background: Last fall, the city council adopted an assessment roll for
improvements to Terrace Drive from Lincoln Drive westerly to the cul -de-
sac, connecting with.the existing Terrace Drive at the ditch.
Assessments were levied against all benefiting properties consistent
with past city assessment policy. Municipal State Aid funds were also
available to supplement the project financings
Prior to constructing the improvement, when the public improvement
hearing phase was being considered by the council, I received a request
from Lincoln Development for consideration for a possible assessment
reduction. This was based on the fact that they previously constructed
the segment of Terrace Drive from Lincoln westerly to provide access for
the Edina Realty building and shopping center. Since this segment of
road would have to be removed and reconstructed to facilitate the city
project,-they felt they should receive gone credit for past
construction.
1 agreed in concept with the request and agreed to reduce their
assessment upon receipt of a written request at the time the project
assessment hearing were held. Unfortunately, at the time- .the project
was assessed last fall, owners of the Rosedale Square Forth Shopping
Center property and office building were in bankruptcy proceedings.
Since no written request came from the property owners at that time, we
proceeded with an assessment against all parcels in the -full amount
consistent with the city assessment policy*
We have now received a letter from the bank that now owns title to the
former Rosedale Square North property including the retail center and
office building. The letter, a copy of which is attached, requests the
reduction of the assessed amounts consistent with past agreements I had
with the former owner. The request would be to reduce the assessments
against the property by approximately 60% from $126,000 to 5 3, 5 0 0.
Policy objectives* The-request from Norwest Bank is consistent with
past written agreements between my office and the former shopping center
ownerse Because the property was in bankruptcy proceeding, the request
was not fo rm ally made in writing from the property owners. The
assessment was levied as originally recommended. Had the request been
made during the assessment proceedings, it would have been reasonable
Page 2

and consistent, since there would have been a reduced benefit from the
Terrace Drive project accruing to the Rosedale Square North parcels.
They had previously paid the full cost for the old Terrace Drive
constructions The request now seems reasonable and consistent with
past assessment policy and practice in similar situations;
Financial implicationsoo As noted in the letter from Norwest, the
request is to reduce the assessment from $125,961.91 to $53,526.73, or a
reduction of $
The project has adequate funding due to Municipal State Aid funds -being
applied to the project. In fact, the project is "over financed since
special assessments and Municipal State Aid funds were used to the
maximum extent allowed by state aid rules and assessment policy.
Therefore, the reduction requested can be made without adversely
affecting project financing

Re: City of Roseville Special Assessments, City Project 91-04, terrace Drive
Construction
Dear Mr. Gatlin:
As you know Norwest Bank Minnesota, N.A. recently took title to the property known as
Rosedale Square North which Includes both a retail center and an office building located
on the following tax parcels:
Retail Center: 04-29-23-41-0025
04-29-23-41-0026
Office Building: 04-29-23-41-0023
04-29-23-41-0024
During the foreclosure perlod It came to the bank's attention that there were several
unresolved issues regarding both special assessments and easements affecting three of
the four properties (parcel 26 was not involved). Unfortunately, since the bank Was not ire
tale, there was nothing that it could do regarding those Issues. This Is no longer the case
now that the foreclosure period is over and the bank owns the properties.
A to the special assessments, k Is our understanding that $125,961.91 was assessed
against parcels 23,24, and 25 In conf unction with the construction of Terrace Drive and
related storm sewer work. in your letter of February 1, 1993 you indicated that you had
previously agreed on a discount of these assessments with the previous owner, Rosedale
Square North Lim tbd Partnership} since the above referenced parcels received only
reduced benefits from the Improvements. Unfortunately tmt agreement was never
formalized to the partnership filing bankruptcy and the properties were assessed for their
full share of the Improvement costs. At this time Norwest asks that the cry of Roseville
amend the assessment rolls as follows which Is In line with the prior agreement:

The other outstanding issue Is the payment to Norwes't by the City for temporary and
permanent easements associated with the construction of Terra6e Drive. According to our
records the City had previously proposed to pay $3,1 85.00 for these easements. While
Nor west does not have all of the documentation associated with the easements, Including
the final survey, it Is the bank's understanding that this amount was acceptable to the prior
per but again was not formalized due to the bankruptcy. since the former owner found
the amount and terms acceptable it is most probable that Norwest would also but we
would appreciate reoeiving copies of the appropriate documents so that an Informed
decision can be robe,
It is Norwest's desire to resolve nth of these Issues as quickly as possible and to that end
your past and future assistance and operation is very much appreciated. if you have
any questions or creed any additional Information please feet free to call me at 667 -0539.
Again, thank you for your help on these matters.

Staff recommendation: A detailed description of the change order for

the charge order, we feel the request from the contractor as described
by the architect is reasonable and recommend that Change order 1A be
approved in the amount of ,017e Also, charge Order 2, the provision
of the roof scuppers, was necessary to provide proper drainage for the

1993 winter season. Future consideration will have to be given to re-
roofing the license bureau.
Staff recommends the council approve change orders 1A# 2, and 3 for

Mar Steve:
We have received f corn McPhillips Roofing and are forwarding to you bps for the above -
referenced project.
Change Order No. is fox adding an expansion ,point and reflashing the joint between high and
low roof at the Public works Facility.
The work of patching the License Bureau was .done as requested, is outside of the contract with
McPhillips, is acceptable and should be paid.
The work on the Fire Station #3 is complete and the Application for Payment is enclosed with its
sun ary sheet. Please note that the cost to McFhihips was $5,017 above the Not to Exceed
amount of the C.0. The basis for McPhillips' proposal for this work was based upon our walk-
through with Joe Hewett. It was not based upon drawings which due to tuning were prepared
afterward. In the course of the existing construction document review and the p aration of
TKDA's construction docurnent, it became clear that an expansion joint was required on the east
d west walls which am load. bearin to take up the put t` l structural movement. The

Per 2.f service
1993 $17e5O
1994 $20.00
will have estimated costs to the City as follows
1994 $1191000

The estimated amounts could change depending on the actuarial -
makeup of the group as to age and years of service.
In addition, the amount in 1996 and beyond will depend upon how
well the Board' s investments do with respect to decreasing the
unfunded liahil i ty a Current projections would indicate no un-

There are no costs for 1993, since the actuarial calculation will

improvements for Lincoln give from county Road C-2 to Lydia Avenue.
The proposed improvements include the construction of a roadway with
.paving and concrete curb and gutter, and installation of necessary
utilities to sera the development including waterma in, sanitary sewer,
and stogy--m surer. The developers are asking that the feasibility study
be prepared and a public improvement hearing be held to determine
whether the project should proceed. At this point, the developers are
requesting that the city construct the improvements and assess the
cost against the benefiting{propert. A map showing the proposed
improve ants is attached
Three years ago the - council considered the extension of Lincoln Drive
tat time
north of Terrace Drive. The segment under consideration at h
included the portion of Lincoln between Terrace Drive and county Road
C2 and County Road Cow2 from Lincoln to Snelling. No serious
consideration was given for extension of Lincoln north of County Road
C- 2e At that time the council chose not to ore. :r the project primarily
because of concerns expressed by proper-*--*,? owne } along the segment of
proposed Lincoln Avenue south of County Road C--2 also owning property on
the Snelling Avenue Frontage Roads The council expressed an interest in
proceeding with the entire project in the future at such time as the
Paul's Place redevelopment moved ahead.
Since that project is now seriously being considered, it seems
appropriate to consider the extension of Lincoln give along the entire
incomplete section from Terrace give to County Road C-2 and from county
Road Ca-2 to Lydia Avenue. Also, to complete the project, it will be
necessary to reconstruct county Road C-2 between Snelling and Lincoln
including signal modifications at the intersection of county Road C -2
and Snelling.
When the the Lincoln give extension was considered. previously, many of
the d.egign issues were addressed at that times These eluded roadway
