QUEST FOR co II L ACTION DATE: 3 8 9 9 <br />ITEM O.: P�l <br />Department Approval: Manager Reviewed: Agenda Section <br />Reports and Recommendations <br />Item Description: Amending assessment roll, St. Rose of Lima appeal, <br />City project p -49 15, P- 91w--0 3p P-91-02-57, <br />Background: Last September, the City Council adopted resolutions <br />accepting assessment -rolls for the above listed projects* At that time, <br />assessments were levied against St. Rose of Lima Church for all <br />frontages in the full amounts recommended a The total amount of the <br />assessments was being slightly less than $72,000. During the time the <br />assessment roll was considered, St. Rose -filed a written objection to <br />the assessment and indicated they would appeal unless the. assessments <br />were reduced. Subsequent discussions were not able to resolve the <br />utter, and the assessment roll was adopted as presented. <br />Later action by attorneys for St. Rose resulted in a formal notice of <br />assessment appeal being filed with the district court Since that date, <br />our attorney has be6n negotiating with legal counsel for St. Rose in an <br />attempt to reach an out of court settlement. A tentative, settlement has <br />been reached and is presented to the council for its consideration • <br />Policy objectives: Assessments for the projects were levied in , <br />accordance with City of Roseville assessment policy. used on advice <br />from the city's appraiser and attorney, it appears that the assessments <br />as proposed originally may exceed the benefit.
