EXTRACT OF MINUTES OF MEETING OF THE <br />CITY COUNCIL OF THE CITY OF ROSEVILi,F <br />Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of <br />Roseville, County of Ramsey, Minnesota, was held on the 15th day of December, 2003, at 6:30 <br />p.m. <br />The following members were present: <br />and the following were absent: <br />Council Member <br />introduced the following resolution and moved its adoption: <br />ESOLUTION NO. <br />A 1 E SOLUTION "PROVING T A 39 FOOT VARIANCE To SECTION I0I6.16A of <br />THE RO EVIL CITY CODE FOR JIM BADZINSIG <br />385 SOUTH OWASSO BOU VARD (PF3540). <br />WHEREAS, Jim Badzinse has requested a VARIANCE to Section 1016.16A of the <br />Roseville Ile City Code to allow the construction of an attached deck on the lakeshore side of the <br />principal structure he owns; and <br />WHEREAS, the B adzinski parcel is located at 381 South Owasso E oulevard, and legally <br />described as: <br />Lot J Lake Owasso Villa <br />PIN.- 01 -29- 23!21 -0002 <br />WHEREAS, Section 10 16.16A (Placement of Structure on rcqulres a principal <br />structure to be set back a minirnurn of 75 feet from the ordinary high watermark of a tale; and <br />WHEREAS, , the deck proposed by Mr. Badzinski would be located 36 feet from the <br />ordinary high watermark of Labe Owasso; and <br />WHEREAS, The Roseville Planning Commission held the public hearing regarding the <br />Badzinsli request on December 3, 20031 recommending (6 -1) approval of a 39 foot VARIANCE <br />to Section 1016.16A of the Roseville City Code, based on the findings of Section 5 and <br />conditions of Section 6 of the project report dated December 3, 2003; <br />NOW THEREFORE BE IT RESOLVED, by the Roseville City Council, to APPROVE a <br />3 9 foot VARIANCE to Section 1016.16A of the Roseville City Code for Jim B adzinske, 3 S 1 <br />South Owasso Boulevard, subject to the following conditions; <br />a. The deck being a maximum size of 12 feet by 12 feet. <br />
