EXTRACT OF MINUTES OF MEETING OF THE <br />CITY COUNCIL OF THE CITY OF ROSEVILLE <br />Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of <br />Roseville, County of Ramsey, Minnesota, was held on the 15th day of December, 2003, at 6:30 <br />p.m. <br />The following members were present: <br />and the following were absent: <br />Council Member <br />introduced the following resolution and moved its adoption: <br />RESOLUTION NO. <br />A RESOLUTION APPROVING A 18 FOOT VARIANCE TO SECTION 1016.22C3 OF <br />THE ROSEVYLLE CITY CODE FOR JIM BADZYNSKI <br />385 SOUTH OWASSO BOULEVARD (PF3540). <br />WHEREAS, Jim Badzinski has requested an 18 foot VAIRJANCE to Section 1016.2203 <br />of the Roseville City Code to allow the construction of an attached deck on the Lakeshore side of <br />the principal structure he owns; and <br />WHEREAS, the Badzinski parcel is located at 381 South Owasso Boulevard? and legally <br />described as: <br />Lot ]]fake Owasso Villa <br />P1 , 01-29-23-21-0002 <br />WHEREAS a Section 1016.220 onconf'orrnities — Deck Additions) reads: Deck <br />additions may be allowed, without a variance, to a structure which does not meet the required <br />setback from the ordinary high water level, if all of the following standards are met: <br />The structure existed prior to the date the City's original shoreland structure <br />setbacks were established, March 27, 1974. <br />2. A thorough evaluation of the property and structure reveals no reasonable <br />location for a deck meeting or exceeding the existing ordinary high water level <br />setback of the structure. <br />3. The new deck encroachment toward the ordinary high water level does not exceed <br />15% of the existing setback of the structure from the ordinary high water level or <br />does not encroach closer than 30 feet whichever is more restrictive; and the deck <br />shall be constructed of materials similar to the materials of the principal structure, <br />woad, or earth tone; and the new deck shalt not be roofed or screened. <br />
