Regular City Council Minutes — 11/24/03 <br />DRAFT Minutes - Page 22 <br />someone didn't feel they could make a complaint through <br />the City Manager for some other reason, as discussed by <br />the City Attorney with the City Manager for his approval, <br />the City Attorney would serve as designated to receive a <br />complaint and serve as a conduit for the complainant, and <br />refer the matter to the City Manager as the City's <br />discretionary authority. City Attorney Anderson referred <br />to City Council's standing Rules of Procedure, Rule #7. <br />City Attorney Anderson also clarified that if someone <br />sought data under the Data Practices Act, the City <br />Manager or his delegated staff person as the City's Public <br />Infornlation/Data Practices Authority, reserved the right to <br />process such requests. <br />X. Ordinances &Resolutions <br />XI. Consent Agenda <br />A. Approving Change Orders and an Alternate Bid <br />Regarding the City's Construction Pr oject <br />Councilmember Kough questioned why the Construction <br />Company's Manager on site had not caught the items <br />addressed in Consent Agenda item XI., A, "Approving <br />Change Orders and an Altemate Bid Regarding the City's <br />Construction Project," negating further Council action. <br />Project Manager Schwartz recognized Councilmember <br />Kough's concerns, noting the complexity of the project, <br />and the usual number of Change Orders and Alternates <br />required in a project of this nature. <br />Discussion items included concrete pouring for the <br />elevator shaft and contractor responsibilities for cable cuts. <br />Mayor Kysylyczyn expressed appreciation to the Staff s <br />Infornnation Technology Coordinator Ter Hauser for his <br />alertness in noting the cable cut issues, and seeking <br />compensation from the contractor. <br />Ordinances & <br />Resolutions <br />Consent Agenda <br />Approving Change <br />Orders and an <br />Alternate Bid <br />Regarding the <br />City's Construction <br />Project <br />
