Revised City Attorney <br />Special Election Ordinance No. 1 <br />(Addresses legal issues in version passed by <br />Council) <br />City of Roseville <br />ORDINANCE No. <br />AN ORDINANCE AMENDING <br />TITLE ONE, SECTION 103.0 <br />FILLING A COUNCIL VACANCY <br />THE CITY OF ROE ILLE ORDAINS: <br />SECTION I Title One, Section 103.06 of the Roseville City Code is added to read as <br />follows: <br />103.06: FILLING A COUNCIL VACANCY <br />A. Appointment: The Council shall appoint an el gib1e_person to f ill a vacanev on the <br />ity_ Council as soon as is 1practicahle after the vacancyoccurs � person <br />a ointed shall serve for the une ired portion of the term unless a s ecial <br />election is re uired hereunder or by state law. <br />E. - ... Special Election: <br />1. A s ecial election shall be held to fill a vacancy on the City Council created <br />when a councilmember is elected tQ, and assumes, an incompatible office. if ` more <br />than sip months remains in the unexvired term and the vacancy occurs more <br />than sip months before the next re tar cily election. This siDecial election <br />shall be held as soon after the vacancy is declared as 1 tical under state law. <br />No special VLn:mM electron is required hereunder. . <br />2., In the case of all other vacancies where a special _election is net required by <br />state law a special election to fill the vacanqy. shall occur at the next regglarly <br />scheduled state or city general election, as jgquired by state law, unless the <br />vacancy occurs after rinsert &tel.
