DR- I <br />THE CITY OF ROSEVILLE ORDAINS: <br />Devised City Attorney <br />Special Election Ordinance No. 2 <br />(Drafted in response to a request by <br />Couneilmember Klausing) <br />SECTION 1: Title One, Section 103.06 of the Roseville City Code is added to read as <br />follows: <br />103.06: FILLING A COUNCIL VACANCY <br />A. ointment: The Council shall qppoint an eligible person to fill a vacancy on the <br />City Council as soon as is practicable after the ,vacancy occurs. The person <br />a ointed shall serge for the une ired iDortion of the term or until a successor is <br />qualified after a s ecial prim@U election or a special election held as required .. <br />hereunder- <br />E . Special Election: <br />1. A special election shall be held to fill a vacancy on the City Council created <br />when a couneilmernber is elected to and assumes an ineo ble office if more <br />than sip months remains in the unexvired term and the vacancy occurs more <br />than six (6) _months before the next, reaular city election. This special election <br />shall be held as soon after the vacancy is declared as is raetieal under state law <br />and after a special immary election if one is required hereunder, unless a <br />candidate at a s eeial pnmM election receives more than 0% of the votes. If a <br />candidate at a s ecial primary election receives more than 0% of the votes a <br />sy ial election will not be held and the candidate who received the highest <br />number of votes at the special primary election shall be Vppointed, by the Council <br />to fill the vacant office for the remainder of the tenn. <br />.Notwithstanding the provisions of this Ordinance, if a special election is <br />mandatory under state law e s ecial election shall occur as re uired bv state <br />law, and the provisions of Section B(1) shall not any.
