Purpose. The Roseville City Code, Title 11, Sections 1102.01 E <br />12 through G is hereby amended by revising language regarding required public hearings. <br />13 Minnesota State Statutes 462.358 and City Code Section 1102.01, E through G require that a <br />14 public hearing must be held on subdivisions at the time that preliminary plat approval is <br />15 requested. Section 108 of the City Code requires such hearings be held by the Planning <br />16 Commission. The Statues do not require a public hearing prior to final approvals by the City <br />17 Council. This ordinance makes the City Code consistent with the State Statutes by deleting a <br />18 required second public hearing prior to final approval. <br />19 SECTION 2.- Section 1102.01, E through G is hereby amended as follows: <br />20 E. Action By The City Council: (on preliminary plats) <br />21 <br />22 1. The recommendation of the Planning Commission on the preliminary plat shall be <br />23 considered by the City Council, and the City Council shall approve or disapprove the plan <br />24 within sixty (60) days after the application was accepted as complete or such date as <br />25 extended by the applicant or City Council. If the City Council shall disapprove said <br />26 preliminary plat, the grounds for any such refusal shall be set forth in the proceedings of the <br />27 City Council and reported to the person or persons applying for such approval. (Ord. 1176, <br />28 11 -25 -1996) <br />29 <br />30 2. Approval of the preliminary plat shall not be construed to be approval of the final plat. <br />31 (1990 Code; 1995 Code) <br />32 <br />33 F. Final Plat: <br />34 <br />35 1. Final Plat Submission: After approval of the preliminary plat by the City Council, the <br />36 owner or subdivider shall, within sixty (60) days thereafter, submit to the City a new <br />37 application for final plat approval. Unless given a time extension, the failure to submit a <br />38 complete application for final plat approval within cemply with-the sixty (60) day period, <br />
