EXTRACT OF MINUTES OF MEETING OF THE <br />CITY COUNCIL OF THE CITY OF ROSEVILLE <br />Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of <br />Roseville, County of Ramsey, Minnesota, was held on the 20th day of October, 2003, at 6:30 <br />p.m. <br />The following members were present: <br />and the following were absent: <br />Council Member <br />introduced the following resolution and moved its adoption: <br />RESOLUTION NO. <br />A RESOLUTION APPROVING A 16 FOOT VARIANCE TO SECTION 1004.01A7 & <br />SECTION 1004.02D4 OF THE ROSEVILLE CITY CODE <br />FOR DIANNE PECK 2874 DELLWOOD STREET (PF3532). <br />WHEREAS, Dianne Peck has requested a VARIANCE to Section 1004.01A7 and <br />1004.02134 of the Rosev9ille City Code to allow the construction of a 624 sq. ft. detached <br />accessory building 14 feet from the corner side yard property; and <br />as: <br />WHEREAS, the Peck residence is located at 2874 Dellwood Street, and legally described <br />Lot 1, Block 6 FERNWOOD TERRACE PLAT 3 <br />PIN. 03- 29 -23 -42 -0040 <br />WHEREAS, Section 1004.01A7 (Location) of the Roseville City Code states: "No <br />accessory building or garden shed shall be erected of located within any front yard. Accessory <br />buildings and/or a garden shed shall be located behind the established front building line of the <br />principal structure; and <br />WHEREAS, Section 1004.02D4 of the Roseville City Code states: A side yard adjacent a <br />street on a corner lot shall not be less than 30 feet (Ord. 275, 5/12/59 and amended in 1995), and <br />WHEREAS, the proposal seeks to construct a detached accessory building 14 feet from <br />the north property line (corner lot side yard) which requires a 16 foot variance to Section 1007.0 - <br />IA7 (Location) and 1004.02D4 (Side Yard Setback adjacent a Public Street); and <br />WHEREAS, The Roseville Planning Commission held the public hearing regarding the <br />Peck request on October 1, 2003, recommending (6 -0) approval of the two variances based on <br />the findings of Section 5 and conditions of Section 6 of the project report dated October 1, 2003; <br />
