EXTRACT OF MINUTES OF MEETING OF THE CITY COUNCIL OF THE CITY OF ROSEVILLE Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of Roseville, County of Ramsey, Minnesota, was held on the 20th day of October, 2003, at 6:30 p.m. The following members were present: and the following were absent: Council Member introduced the following resolution and moved its adoption: RESOLUTION NO. A RESOLUTION APPROVING A 16 FOOT VARIANCE TO SECTION 1004.01A7 & SECTION 1004.02D4 OF THE ROSEVILLE CITY CODE FOR DIANNE PECK 2874 DELLWOOD STREET (PF3532). WHEREAS, Dianne Peck has requested a VARIANCE to Section 1004.01A7 and 1004.02134 of the Rosev9ille City Code to allow the construction of a 624 sq. ft. detached accessory building 14 feet from the corner side yard property; and as: WHEREAS, the Peck residence is located at 2874 Dellwood Street, and legally described Lot 1, Block 6 FERNWOOD TERRACE PLAT 3 PIN. 03- 29 -23 -42 -0040 WHEREAS, Section 1004.01A7 (Location) of the Roseville City Code states: "No accessory building or garden shed shall be erected of located within any front yard. Accessory buildings and/or a garden shed shall be located behind the established front building line of the principal structure; and WHEREAS, Section 1004.02D4 of the Roseville City Code states: A side yard adjacent a street on a corner lot shall not be less than 30 feet (Ord. 275, 5/12/59 and amended in 1995), and WHEREAS, the proposal seeks to construct a detached accessory building 14 feet from the north property line (corner lot side yard) which requires a 16 foot variance to Section 1007.0 - IA7 (Location) and 1004.02D4 (Side Yard Setback adjacent a Public Street); and WHEREAS, The Roseville Planning Commission held the public hearing regarding the Peck request on October 1, 2003, recommending (6 -0) approval of the two variances based on the findings of Section 5 and conditions of Section 6 of the project report dated October 1, 2003;
