5.0 BACKGROUND: <br />5-1 periodically the Community Development staff reviews Code violations relating to <br />property maintenance to detennine whether there are properties in disrepair for an <br />extended period. The staff spends time attempting to gain compliance during this time on <br />these properties. Generally they have not met the Code because the owner has been unable <br />(physically or financially) or unwilling to comply with the Code. .A Ramsey County Court <br />Citation is one remedy. It allows an impartial third party (Ramsey County judge) to <br />assess the situation and make a ruling. The Community Development Department <br />anticipates the judge will require the property owner to do the clean up and to l icense or <br />remove the vehicle. <br />5.2 This process has been successfully used in previous gears to resolve long - standing <br />nuisance complaint violations. <br />5.3 The staff attempts to work with property owners to bring the structure into compliance <br />(and continue to encourage property owners to repair properties up to the time of a <br />Council hearing). <br />6.1 The Council has requested that each time a County Court Citation is considered to resolve <br />a long standing nuisance case, the Council review the case and provide direction prior to <br />authorizing the City prosecuting Attorney to proceed. <br />6.2 The City goals within the Comprehensive Plan are to protect and improve property values <br />(Goal 3, 4 and 5; page 6 and, Section 3) and to adhere to performance standards which <br />protect the integrity of the housing units and the neighborhood (policy 6, page 8, Section <br />3). <br />i1 -1 M MIM �L <br />Staff recommends that the Council direct the staid' to work with the city prosecuting <br />attorney to cite (Ramsey County Court citation) the ownerfor the specific violations of <br />the Code. <br />7. 2 other options include: 1) Do nothing — allow the violation to continue. ) Proceed with ,o, <br />City Nuisance Abatement Dearing and clean up the site with city funds, which is slower <br />and tales more staff time.
