Creation; members; duties. The <br />governing body may create an advisory beard except in cities of <br />the first class where the governing body shall create an <br />advisory board. Except as provided in subdivision 2, a majority <br />of the members shall be owners or occupants of real property <br />located in or adjacent to the development district which they <br />serge* The advisory board shall advise the governing body and <br />the administrator on the planning, construction, and <br />implementation of the development program, and maintenance and <br />operation of the district after the program has been completed. <br />Subd. 2. Substantially residential districts. In a <br />substantially residential development district the board sha11 <br />be compri fed of owners and occupants of real property within or <br />adjacent t�d -the district's boundaries. The board may be <br />appointed or elected according to guidelines established by the <br />governing body, provided that the board in the cities of St. <br />Paul and Minneapolis must be elected. For purposes of this <br />subdivision a "substantially residential development district" <br />is a development district in which 40 percent or more of the <br />land area, exclusive of streets and open space, i's used for <br />res id.ential purposes at the time the district is designated bar <br />the governing body. <br />Subd. 3. Powers. The governing body shall by <br />resolution delineate the respective powers and duties of the <br />advisory boards and the planning staff or agency. The resolution <br />shall establish reasonable time limits for approval by the <br />advisory board of the phases of the development program, and <br />provide a mechanism for appealing to the governing body for a <br />final decision when conflicts arise between the advisory board <br />and the planning staff or agency, regarding the development <br />program. <br />HIST. 1987 c 291 s 133 <br />==469. 133 {� <br />469.133 Relocation. <br />Unless they desire otherwise{ provision must be made for <br />relocation of all persons who would be displaced by -a proposed <br />development district prior to displacement in accordance with <br />the provisions of sections 117.50 to 117.56.
