Si MA 11, <br />At the Deceinber 2 Council meeting, the Cowicil asked that it be provided inforination on the <br />regulatory options as they exist concerning bus shelters and advertising. This letter summarizes those <br />options. l have attempted to point out the benefits of options where pertinent. <br />Minn. Stat. § 160,27 authorizes cities to regulate the placement of bus benches and shelters. <br />Subdivision two of Section 160.27 authorizes regulations by �; , lxcellse, pert -zit or franchise ...'� <br />Consequently, the Council could adopt an ordinwice or code provisions creating a process where a <br />p ern-i t or license would be issued for shelters and/or benches. Franchises are common in the utility /public service arena. <br />In my opinion, a franchise is the most effective tnea.rts available to the City to regulate shelters <br />and /or benches for three reasons. First, Section 1 60.27 clearly indicates that a franchise tray be <br />granted on the condition the City receives a share of advertising revenue. Second, dealing with <br />applications through a. franchise scheme allows the City, inuch like the PUD process, to use flexibility <br />to deal with the particulars o f each request., Finally, it is niy understanding the capital investinent in <br />shelters requires a longer return period than a. typical annual pen -nit. It seems more appropriate to grant <br />a franchise, rattler than a 10-20 year p ennit or license, <br />
