EXTRACT OF MINUTES OF MEETING OF THE CITY COUNCIL OF THE CITY OF ROSEVIi,T.F Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of Roseville, County of Ramsey, Minnesota, was held on the 2"d day of June, 2003, at 6:30 p. m. The following members were present: and the following were absent: Council Member introduced the following resolution and moved its adoption: RESOLUTION NO. A RESOLUTION APPROVING A 5 FOOT VARIANCE TO SECTION 1004.01A7 AND 1004A2D4 OF THE ROSEVILLE CITY CODE FOR PROPERTY LOCATED AT 421 TRANSIT (PF 3468) WHEREAS, Manuel Gutierrez has requested a variance to Section 1004.01A7 (Location) and 1004.02D4 (Side Yard Setback Adjacent a Public Street) of the Roseville City Code to allow the construction of a 24 Foot by 30 foot (720 sq. ft.) detached accessory building (garage); and at as: WHEREA , the Gutierrez parcel is located at 421 Transit Avenue and legally described Lot 21, Block 3# Mc Carron 's Addition PID 13-29-23-21-0064 WHEREAS, Section 1 004.01 A7 of the Roseville City Code does not allow an accessory building to be located in a front yard; and WHEREAS, Section 1004.02D4 of the Roseville City Code requires a minimum setback adjacent a public street of 30 feet; and WHEREAS, the Gutierrez request would locate (construct) the detached garage 25 feet from the property line adjacent to Irene Street, or an encroachment of 5 feet into the required 390 foot setback; and WHEREAS, the Roseville Planning Commission held the public hearing regarding the Gutierrez variance requests (Section 1004.01A7 & 1004.02D4) on May 7, 2003, and recommended (5 -o) approval of the request, based on findings outlined in Section 5 and conditions of Section 6 of the project report dated May 7, 2003. NOW THEREFORE BE IT RESOLVED, by the Roseville City Council, to grant Manuel Gutierrez a 5 foot VARIANCE to Section 1004.0 1 A7 (Location) and 1004.02D4 (Side Yard Setback Adjacent a Public Street) of the Roseville City Code allowing the construction a 24 .foot by 30 foot (720) detached accessory building (garage) at 421 Transit Avenue, subject to the following conditions:
