<br />WBEREAS,, such agreement requires the City to release an abandoned utility easement,

<br />)AqiEREAS., it has been learned that., a mutual mistake of the parfies was made and thi
<br />the utility easement has not been abandoned but instead, contains a necessary sanitary sewer l,ine;

<br />be released, and a1w, to provide for the sharing of the costs of such relociation by this agreement.
