<br />EXTRACT OF MINUTES OF MEETING OF THE <br /> <br />CITY COUNCIL OF THE CITY OF ROSEVILLE <br /> <br />* <br /> <br />* <br /> <br />* <br /> <br />* <br /> <br />* <br /> <br />* <br /> <br />If <br /> <br />* <br /> <br />Pursuant to due call and notice thereof, a regular meeting of the City <br />Council of the City of Rosevi11e, County of Ramsey, Minnesota, was duly held in <br />the City Hall at 2660 Civic Center Drive, Roseville, Minnesota, on Monday, the <br />thirteenth day of January, 1986, at 7:00 o'clock p.m. <br /> <br />The following members were present: Matson, Cushman, Kelly, Johnson, and <br />Demos. <br />and the following were absent: None. <br /> <br />Member Kehy <br /> <br />introduced the following resolution and moved its adoption: <br /> <br />RESOLUTION NO. 7853 <br /> <br />RESOLUTION HOLDING MoOOT HARHLESS FOR VARIANCE ON CLEVELAND AVENUE <br /> <br />WHEREAS, the City of Roseville proposes to reconstruct a portion of Cleveland <br />Avenue (HSA 160.241) between County Road B-2 and Oakcrest Avenue utHizing <br />State Aid funds; and <br /> <br />WHEREAS, the City of Roseville has requested a variance from 14 MCAR <br />Section 1.5032,H.,I.C Rules for State Aid Operations under Minnesota Statue, <br />Chapters 162 and 163 as amended, so as to permit a minimum roadway width of 40 <br />feet; and <br /> <br />WHEREAS, the state requires that the City of Roseville adopt a resolution which <br />indemnifies, saves and holds harmless the State of Minnesota as a result of the <br />state's decision on the variance; <br /> <br />NOW, THEREFORE, BE IT RESOLVED that the City of Roseville hereby indemnifies, <br />saves, and holds harmless the State of Minnesota and all its agents and <br />employees of and from any and all claims, demands, actions or causes of actions <br />of any nature or character arising out of or by reason of, in any manner, the <br />reconstruction of a portion of Cleveland Avenue (HSA 160.241) from County Road <br />B-2 to Oakcrest Avenue in any other manner than as a street width of 52 feet <br />under Minnesota Rules, Chapter 8820.9912 for urban roadway classifications and <br />further agrees to defend at their sole cost and expense any action or <br />proceeding commenced for the purpose of asserting any claim of whatsoever <br />character arising as a result of the granting of this variance. <br />
