EXTRACT OF MINUTES OF MEETING OF THE CITY COUNCIL OF THE CITY OF ROSEVILLE * * * * * * If * Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of Rosevi11e, County of Ramsey, Minnesota, was duly held in the City Hall at 2660 Civic Center Drive, Roseville, Minnesota, on Monday, the thirteenth day of January, 1986, at 7:00 o'clock p.m. The following members were present: Matson, Cushman, Kelly, Johnson, and Demos. and the following were absent: None. Member Kehy introduced the following resolution and moved its adoption: RESOLUTION NO. 7853 RESOLUTION HOLDING MoOOT HARHLESS FOR VARIANCE ON CLEVELAND AVENUE WHEREAS, the City of Roseville proposes to reconstruct a portion of Cleveland Avenue (HSA 160.241) between County Road B-2 and Oakcrest Avenue utHizing State Aid funds; and WHEREAS, the City of Roseville has requested a variance from 14 MCAR Section 1.5032,H.,I.C Rules for State Aid Operations under Minnesota Statue, Chapters 162 and 163 as amended, so as to permit a minimum roadway width of 40 feet; and WHEREAS, the state requires that the City of Roseville adopt a resolution which indemnifies, saves and holds harmless the State of Minnesota as a result of the state's decision on the variance; NOW, THEREFORE, BE IT RESOLVED that the City of Roseville hereby indemnifies, saves, and holds harmless the State of Minnesota and all its agents and employees of and from any and all claims, demands, actions or causes of actions of any nature or character arising out of or by reason of, in any manner, the reconstruction of a portion of Cleveland Avenue (HSA 160.241) from County Road B-2 to Oakcrest Avenue in any other manner than as a street width of 52 feet under Minnesota Rules, Chapter 8820.9912 for urban roadway classifications and further agrees to defend at their sole cost and expense any action or proceeding commenced for the purpose of asserting any claim of whatsoever character arising as a result of the granting of this variance.
