AGENDA FOR CONTINUED PUBLIC IMPROVEMENT HEARING <br />TERRACE DRIVE, 91 -04 <br />February 25, 1991 <br />A. Mayor calls the meeting to order and announces the purpose of the <br />hearing and format for the meeting. <br />"This is a continued public improvement hearing to consider whether <br />public improvements should be constructed. The decision will be <br />whether the City Council wishes to proceed with the public <br />improvement project. The decision will not be made at this time as <br />to what the assessment rates will be or how the project costs will <br />be allocated. That will be done at a separate assessment hearing <br />when the project is completed." <br />"This project was initiated as a result of a petition received by <br />affected property owners. Since this project was petitioned by more <br />than 35% of the affected property owners, a 3/5 vote of the city <br />council will be necessary. The council will consider a resolution <br />ordering the improvement or continuing the hearing to a specific <br />future date." <br />THE FOLLOWING AGENDA WILL BE USED AS THE FORMAT FOR THE PUBLIC HEARINGS: <br />B. City Manager comments for public improvement hearing: <br />It is suggested for the continued public improvement hearing, the <br />City Manager read the project number and provide a brief <br />description of the project. Also, a general comment should be <br />made regarding the published and mailed notices and summary of any <br />written objections to the project received. This should include <br />the following language: <br />"In accordance with Minnesota Statute Chapter 429, required, <br />published, and legal mailed notices have been provided for this <br />project. Legal notices appeared in the city's legal newspaper, the <br />Focus, on January 16 and 23, 1991. In addition, mailed notices <br />have been sent to each affected property owner in accordance with <br />the statute. Mailed notices were sent on Thursday, January 17, <br />1991. Affidavits of mailing are available in the office of the <br />Public Works Director." <br />Prior to the hearing proceeding, the City Manager should read all <br />written objections received for the project. <br />C. Engineer provides specific information for project including <br />existing conditions, proposed construction, special conditions, and <br />schedule. <br />D. Finance Director provides specific information for project <br />including cost estimates and assessment model. <br />E. Mayor opens hearing to public. It is suggested that the <br />following comments be made by the Mayor: <br />
