Background: 1. In 1985, the City Council approved a rezoning, special use permit for site plan approval, building setback variances, parking variance, and a vacation of right of way to allow the construction of the Loehmann's Plaza Shopping Center (renamed Rosedale Commons). 2. Special use permit for site plan approval required for setbacks less than 100 feet. 3. Tanurb Co. has submitted a request for an amendment to the special use permit for site plan approval to allow the construction of a loading dock and trash handling area on the rear of the building. This changes the setback slightly and changes the building from what is shown on the approved plan, therefore an amendment is necessary. , 4. The Roseville Planning Commission, on February 13, 1991, continued consideration of the matter until March 13, 1991. 5. Tanurb objected to the delay on the basis that they met the technical requirements for consideration and that they would face potential loss of their tenant. 6. The City Attorney's office, after discussions with Tanurb's attorney, indicated that the City had some legal exposure in the matter and recommended that the Planning Commission conduct a special meeting such that the Council could hear this matter on February 25, 1991 to avoid the delay. 7. The Planning Commission held a special meeting on February 21, 1991 and recommended unanimously that the City Council approve Tanurb's request for a amended special use permit for site plan approval at 2480 Fairview Avenue with the following conditions: a.
