lls1Spvq+_J� <br />REQUEST FOR COUNCIL ACTION <br />Date.- 4/21/08 <br />Item No..- 7.g <br />Department Approval City Manager Approval <br />01 <br />Item Description.- Approve a Resolution for the Final Acceptance and Maintenance for <br />Public Improvements Constructed for BONTEN FIRST ADDITION plat. <br />(PF 43703) <br />I BACKGROUND <br />2 On January 30, 2006, the City Council approved a public improvement contract for the <br />3 BONTEN FIRST ADDITION plat. The contract covered the public improvements included in <br />4 the Bonestroo campus expansion project. These improvements included the redesign of the <br />5 existing Fulham storm water pond and the construction of a public sidewalk connecting their <br />6 building to Terminal Road along the east side of St. Croix Street. The pond redesign included <br />"7 expansion to the north and west, filling in the narrowest portion of the pond and installing two <br />8 box culverts to connect the separated ponds; and construct a four story office building over the <br />9 box culverts (new office building to connect the existing structures/campuses). <br />I ('_) <br />"I'll The City worked with their Engineer during construction to ensure the improvements were <br />12 installed according to approved plans and City specifications. <br />13 POLICY OBJECTIVE <br />14 The City Policy requires the following steps be completed to finalize the construction project.- <br />16 Certification from the civil engineer in charge of the project verifying that all work has been <br />I 7 completed in accordance with the approved plans and specifications. <br />I o A resolution by the City Council accepting the project and beginning the two-year warranty <br />19 period. <br />2o FINANCIAL IMPACTS <br />2 1 Since this was a developer initiated project, the City did not contribute to the cost to construct <br />22 these public improvements. However, as with all infrastructure, the improvements have long <br />23 term maintenance costs. <br />24 St. Croix Pond is an existing facility, the modifi cations that Bonten,, Inc. performed, will not <br />25 increase our long term maintenance costs for this facility. As detailed in the Easement and <br />26 Vacation agreement between the City and Bonten, Inc.; the box culverts installed under their <br />27 building are owned and maintained by Bonten, Inc. <br />28 The sidewalk is a new facility. Since it is in the right- of- way adjacent to a commercial <br />29 property,, the property owner is responsible for snow removal. However, the City will eventually <br />Page I of 2 <br />
