Draft Resolution Attachment J <br />EXTRACT OF MINUTES OF MEETING OF THE <br />CITY COUNCIL OF THE CITY OF ROSEVILLE <br />1� Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of <br />2 Roseville,, County of Ramsey, Minnesota, was held on the 28th day of April 2008, at 6.-00 p.m. <br />3 The following members were present.* <br />4 and was absent. <br />5 Council Member introduced the following resolution and moved its adoption.- <br />1141A <br />'7 A RESOLUTION APPROVING A CONDITIONAL USE PERMIT IN ACCORDANCE <br />8 WITH §1005.015 AND §1013.01 OF THE ROSEVILLE CITY CODE FOR ROSEWOOD <br />91 CENTER PARTNERS AT 2189 SNELLING AVENUE (IMF 08-�014) <br />10 WHEREAS,, Rosewood Center Partners owns the property at 2181-2195 Snelling <br />'I 'I Avenue; and <br />ii 2 WHEREAS,, the subject property is legally described as <br />,13 Section 9 Township 29 Range 23 excluding the N 80 feet and excluding the S 183 feet and <br />,14 excluding the N 30 feet of the S 213 feet of the W 295.83 feet and excluding the triangular <br />,15 parcel described as beginning at a point 33 feet W and 233 feet N of the SE corner, thence S <br />,16 20 feet parallel with the E line, thence W 20 feet parallel with the S line, thence Northerly <br />,1 "7 to the point of beginning; the following E 1/2 of the SE 1/4 of the SE 1/4 of the SE 1/4 <br />18 (subject to Highway and easement) in Section 9 Township 29 Range 23 <br />'19, PIN: 09-29-2 3-�44-0242 <br />20 WHEREAS,, through the applicant, Mark Smith, the property owners seek to allow a <br />2,1 pawn shop, which is a conditionally permitted use in the applicable General Business Zoning <br />22 District and <br />23 WHEREAS,, The Roseville Planning Commission held the public hearing regarding the <br />24 requested CONDITIONAL USE PERMIT, voting 5-1 to recommend approval of the request <br />25 based on public comment and the comments and findings of the staff report dated April 2, 2008; <br />26 and <br />27 WHEREAS,, the Roseville City Council has determined that approval of the requested <br />28 CONDITIONAL USE PERMIT will not adversely affect conditions on, or value of, nearby <br />2 9, properties and will not compromise the health, safety, and general welfare of the citizens of <br />30 Roseville; <br />3,1 NOW THEREFORE BE IT RESOLVED,, by the Roseville City Council, to APPROVE <br />32 the request for a CONDITIONAL USE PERMIT in accordance with Section § 1013.01 of the <br />33 Roseville City Code, <br />Page I of 3 <br />
