warranties of Paragraph 18(b) of this Lease, provided, same is not due to the negligence, willful
<br />conduct, or breach of' this Lease by the indemnified party or any of its elected officials, officers,
<br />employees, agents, or representatives. Notwithstanding the foregoing provisions to the contrary,
<br />neither party shall have any liability for any damages coverable under a standard special form
<br />property insurancie policy with respect to any equipment, real or personal or other improvements
<br />whether, the policy is in effect or not.
<br />Ifeither party fails or neglects to defend such actions when obligated to do so, the other party
<br />may defend the same and any expenses (including reasonable. attorneys' fees) which it may pay
<br />or incur in defending saild actions, as well as the amount of any judmnent or settlement which it
<br />may be required to, play, shall promptly be r e-imbursed by the responsible party.

<br />19. Notices. All notilces., requests, demands, and other communications hereunder shall be in
<br />writing and shall be deemed given if personally delivered or mailed, certified mail, return receipt

<br />a) Owner represents that 1) it has full right, power, and authority to execute this Lease-
<br />has golf and unencumbered title to the Property free and clear of any liens or mortgages;
<br />3) Owner, warrants that Lessee shall have quiet enjoyment of the Property dun*ng the term

<br />b), Owner represents, that Owner has no knowledge of any substance, chemical or waste on
<br />the Owner's property that is identiffied as hazardous, toxic, or dangerous in any applicable
<br />federal, statiI or, local I aw or regulation,
<br />1c) Lessee represents, and warrants that its use of the Premises, herein, will not generate and it
<br />will not store or dispose on the Property nor transport to or over the Property any
<br />hazardious substance, except such materials,: used in, the lawful, ordinary course of Lessee's

<br />against any, release caused by Lessee of any such hazardous subst ance and any damage,
