A <br />area of park land being used for the construction of Twin Lakes Parkway. The de minimis finding will <br />3 indicate that the proposed action, including consideration of the mitigation, will not adversely affect the <br />36 activities,, features,, and attributes that are important to the resource. <br />37 The first step in the de process is for the city to provide a preliminary concurrence letter from <br />3,',3, the "Official With Jurisdiction"' (OWJ) over Langton Lake Park this could be the City Manager or the <br />39 Park and Recreation Director. Such a letter needs to accompany the Preliminary Inc Minimis Request. <br />4o Attached are the draft documents. <br />4 1 What follows is a summary of the steps in the De Minimis process.- <br />42 *,Submit Preliminary De Minimis Determination Request to Mn/DOT State Aid and FHWA for <br />43 approval. <br />44 0 Prepare De Minimis Report for inclusion as an appendix to the Project Memorandum following <br />45 approval of the preliminary determination request by Mn/DOT and FHWA. <br />46 0 Prepare draft legal ad for notification of anticipated Section 4(f) De Minimis determination, for <br />47 City publication. <br />48 0 Prepare response to comments on Section 4(f) De Minimis Report. <br />49 POLICY OBJECTIVE <br />The history on the Arthur street pond parcel is that it was obtained in 1994 for storm water purposes. <br />'i The pond was designed in 1994 and built in 1996 take into account the future construction of Twin <br />52 Lakes Parkway. The original plans to construct the pond show the future Twin Lakes Parkway. <br />53 The official map of Twin Lakes Parkway was approved by the City Council in October 1998. The <br />54 proposed road construction does not remove or displace any improvement constructed using grant funds. <br />55 Staff believes that the proposed action, will not adversely affect the activities, features, and attributes <br />6 that are important to the resource. <br />57 FINANCIAL IMPACTS <br />58 To ensure that these funds are available for Twin Lakes Infrastructure construction,, staff recommends <br />59 that the City proceed with the approval of this process. The Parks Master plan has identified a number <br />6('-) of parcels for purchase that could be used as replacement park land to meet this requirement or there <br />6 1 may be opportunities to designate some excess right of way for this purpose. <br />62 STAFF RECOMMENDATION <br />63 Staff recommends that the City Council approve the preliminary concurrence letter for De Minimis <br />64 Request for the Purchase of Right of Way for the Twin Lakes Parkway Twin Lakes .UAR Subarea I. <br />6` Infrastructure Improvements. <br />66 REQUESTED COUNCIL ACTION <br />67 Motion to approve the preliminary concurrence letter for De Minimis Request for the Purchase of Right <br />68 of Way for the Twin Lakes Parkway Twin Lakes AUAR Subarea I Infrastructure Improvements. <br />Prepared by: D�ebra Bloom, City Engineer <br />Attachments.- A.
