Keel regarding, the vacation, by the City of' the drainage easement of Lot 1. A I Block 1, Belair Lake Josephine Heights No. 2. Following my review of this, inflormation with MY' clienti Martin F. Colon, I make the following obsiervat ions: 1,6 The City of' Roseville apparently feels compelled to vacate al,l but the niortih five felet. of the drainage easement at this time v based, upon prior acti,ons taken with the Rice Creek Watershed District and, the devel,oper of the plat of Belair Lake josephine Heights No, 2,, Bielair Corporation. 2a The City of' Roseville apparieln,tily feels that any surface water priesein,tl,y running from, the Colon and, other contributing properties into, the easement area is within the parameters allowed by Minnesota 4 law so, that Mr. Colion, and, the rest of the public will not be harmed by the, vacation olf the drainage easement. 3* The Cloty Attorney, has- informed me that in his opinion even 'if the public's r,t to use the easement area will be vacated, such A vacati,on wii,l,l not effect the drainage easement rights afforded the III properity owniers within the plat of Bielair Lake Josephine Heights No. 2 undier the Protective Covenants covering the property.
