l 1. TERMINATION N <br />the event that Sarkozy is <br />terminated by the City Council during such time that ark zy is willing, and able <br />to perform the duties of City tanager,, then in that event the City, agrees to pay <br />arknzy a lump, sun cash payment equal to, fifteen months salary if termination <br />occurs within the first year of employment. If during the second year, twelve <br />months salary,, if during the third year nine months salary, and if during any <br />year thereafter, six months salary, Any, severance payments will be witho ut <br />matching deferred compensation payment fIrom the City. In addition to said <br />severance pay, : arkozy shall be paid for any unused vacation. No compensation <br />shall be given for any unused sick leave. However'. in the event Sarkozy is <br />terminated because of his conviction for any, illegal act involving, personal gain to <br />himself, then the city shall have no obligation to pay the aggregate salary, <br />accrued and unused vacation or sick leave provided in this paragraph, r- <br />If the City at any time during the a ployinent term reduces the salary or other <br />financial benefits f' arkozy in a greater percentage than across-the-, board <br />reduction for all City employees, or if the City refuses, following written notice} <br />to comply with any other previsions in this Agreement benefiting Sa,rkozy, then <br />Sarkozy moray, at his option, be deemed to be "terminated" on the date of such <br />reduction or, refusal to comply with the provisions of this Agreement. In this <br />+event, Sarklozy shall be entitled to severance pay, in accordance with this <br />Agreement. <br />
