PIK claimi'ng that the damage <br />th,ey sufferied, as a result of the taking were in excess o, <br />p <br />$400,000.00 and, the City claims $70,,1000,00, <br />The matter was-then placed on the trial calendar and prior to <br />triial the casie was, stricken from the calendar, Technically we <br />01 <br />a,rle awaiti'ng a new tri,al date,, although it has taken much too <br />long, a time for the Court to set a new trial date. <br />Neither PIK Terminal nor the City 'has asked the clerk of court <br />why the mat,t,er has not bleen reset for trial. if either party did <br />at this tiime I would anticipate, that the case would be scheduled <br />vi <br />for triial within slix, months, <br />You may riecal,l that a,fter the colmmissioners 'issued their award- <br />there were several attempts made to settle this case. Meetings <br />0 <br />were held between representatives of the City and PIK terminal <br />I# unfortunately the matter s settled, <br />In the event this case goes to trial there "is a good likelihood <br />that thie jury will award an amount excess o.f the $170,000.00 <br />clommissioners" av4ar,id. it is not unforeseeable that the jury <br />ip <br />verdict could be in excess of $250,10010.00.
