Rie: PIK Terminal Condemnation
Gur File No. 1011-15
You, have asked for a status report, on the above condemnation.,
Thisi casie went, bilefor,e commissioners on May 29, 301 31, and June 6
..I
anu 7, 19184, anid thie commiss 'loners awarded damages to PIK
6
Terminal 'in the amount of $170,000.00.
oss appeals wierie then filed with, the Ramsey County Distric
Q
Clourt asking for a, 3Urly trial. PIK claimi'ng that the damage
th,ey sufferied, as a result of the taking were in excess o,
p
$400,000.00 and, the City claims $70,,1000,00,
The matter was-then placed on the trial calendar and prior to
triial the casie was, stricken from the calendar, Technically we
01
a,rle awaiti'ng a new tri,al date,, although it has taken much too
long, a time for the Court to set a new trial date.
Neither PIK Terminal nor the City 'has asked the clerk of court
why the mat,t,er has not bleen reset for trial. if either party did
at this tiime I would anticipate, that the case would be scheduled
vi
for triial within slix, months,
You may riecal,l that a,fter the colmmissioners 'issued their award-
there were several attempts made to settle this case. Meetings
0
were held between representatives of the City and PIK terminal
I# unfortunately the matter s settled,
In the event this case goes to trial there "is a good likelihood
that thie jury will award an amount excess o.f the $170,000.00
clommissioners" av4ar,id. it is not unforeseeable that the jury
ip
verdict could be in excess of $250,10010.00. We, of course, will
b,e arg,uinig t,ha,t, the City's appraisal of $70,000.00 is more
