73 2.2 The City Council may also initiate the process of amending the Comprehensive Plan <br />74 Land Use Map. <br />75 3.0 SUMMARY OF RECOMMENDATION <br />76 Since the City Code does not permit adjacent property owners to petition for a <br />77 Comprehensive Plan —Land Use Map Amendment, the Community Development <br />78 Department/Planning Division believes it made the correct determination in denying the <br />79 petition by the Woods Edge Homeowners Association and Old Highway 8 Neighborhood <br />80 residents. The property owners at 3253 (the John and Helen Heinz Estate) and 3261 (Mr. <br />81 Thomas Ranallo) have not requested nor applied to the City for a Comprehensive Plan — <br />82 Land Use Map Amendment of their properties. <br />83 4.0 PLANNING COMMISSION ACTION <br />84 4.1 On February 2, 2011, the Roseville Planning Commission discussed with the City <br />85 Attorney and the City Planner the appeal for Woods Edge Homeowners Association and <br />86 the Old Highway 8 Neighborhood residents and the action necessary. <br />87 4.2 At the meeting a few neighborhood residents addressed the Planning Commission <br />88 regarding the petition/appeal. Although understanding of the fact that the item was a <br />89 determination regarding an administrative decision by the Planning Division and not a <br />90 discussion on what the land use designation and/or zoning classification should be for the <br />91 subject two parcels, most of the residents that addressed the Commission sought the <br />92 Commission's support for the land use change. <br />93 4.3 The Planning Commission voted (5-0) to recommend to the City Council that the <br />94 petitioners do not have standing pursuant to Roseville City Code Section 201.07 or <br />95 otherwise to petition for a Comprehensive Plan Amendment and that the Community <br />96 Development Director made the proper decision not to proceed with the request made by <br />97 the Woods Edge Homeowners Association and the Old Highway 8 Neighborhood <br />98 residents in their petition. <br />99 5.0 SUGGESTED CITY COUNCIL ACTION <br />100 ADOPT A RESOLUTION with FINDINGS,, affirming that the petitioners do not have <br />101 standing pursuant to Roseville City Code Section 201.07 or otherwise to petition for a <br />102 Comprehensive Plan Amendment and that the Community Development Director made <br />103 the proper decision not to proceed with the request made by the Woods Edge <br />104 Homeowners Association and the Old Highway 8 Neighborhood residents in their <br />105 petition. <br />106 Prepared b y: City Planner T'homas Paschke <br />107 Attachments: A.
