AGREEMENT' <br />THIS AGREEMENT, entered into this day of <br />1,984, by and between the City of Roseville ('hereafter "City") and Presbyterian <br />Homes of Minnesota,, Inc., a nonprofit corporation (hereafter "Presbyterian <br />Homes"'). <br />WHEREAS, Presbyterian Homeis has applied for the rezoning of the <br />i,te in the City from R-I to R-3 <br />northerly portion of the Lake johanna School s i <br />I <br />and for a specia,l use, permit to operate a nursiing homei on said property. <br />WHEREAS, Presbyterian Homes has rie,quested the City to indicate its <br />willingness to issue industrial revenue blonds, to partially finance construction <br />work to be, performed on, the building located on said property. <br />W'HERE,AS,, Presbyterian Homes intend's to dedicate approximately six (6) <br />acres of the Lake Johanna School property to the City for park, recreation, and <br />I <br />tiplen, space purposes and other smalleirl portions of said property for right-of-way <br />&NIU*= <br />WH,E,REASO it 'is the intent of the parties to set', forth their respective rights <br />and obh 'I in g, special use permit, bond issuance, <br />1,gat"ons with regard to such rezo,n* <br />and dedications min this Agreement. <br />' W- <br />NOW, THEREFORE, in cons id eratio n of the mutual promises of the parties <br />set forth below, the parties hereby agree as follows: <br />The City shall adopt the ordinance attached hereto as Exhibit A, <br />rezoning the property legally described therein from R-I to R-3, as those <br />designations are defined in Chapter 7 of the Roseville City Code, <br />The City shall LiSsue a speicial use permit pursuant to Roseville City <br />Code Section 7'.360�(3), allowing Presbyterian Homes to operate a nursing home on <br />
