March 116, 198L <br />�2- <br />Our City Attioriney has adviosedi that limiting the number of off-sale <br />licenses to one would have the same affect as establishing an exclusive <br />0 <br />franchise in the City, The Attorney General has given us the opinion <br />that, such an, exclusive franchise would be unlawful, (See Roger Jensen' <br />lett,er da,ted January, 213, 1984)a 1 <br />The League of Minnesota Cities., in, their pamphlet, "Mun'cipal Liquor <br />Dispensories", states as follows.i <br />"Attempts t,io give the buyer, of the store, fixtures or stock <br />an additilonal incentive to purchase; such as limiting Potenti1a <br />competietion, by issuing oinly, one license., may run afoul of the <br />F'ed,eral anti-trust laws.11 I <br />It wolul,d be le 0 <br />,ga,l for the City to sell the equipment and inventory to <br />an, off-sa,le licensee as, long as, the number of licenses was not limited <br />to one. An off-siale licensee could also, negotiate a lease with Har Mar <br />for the same store, lif desired. <br />
