North: <br />o e e conc e 4 <br />Yu hav rquested an opinion, rning what procedure the City would follow <br />in terminating 'its municipal I" <br />iquor store operation and the procedure to be� <br />followeld in establishing off -isal,e liquor licenses within the City. <br />I <br />Our letter to the City, dated February 24i, 1,1977 covers, those two questions, I <br />have attachied a copy of that letter, for your reference. <br />The $2100.010 per year fee for, the off-sale licenses continues to be the statutory <br />ma it and we understand that several cites, have secured special legislation <br />allowing for higher license fees, <br />You also a or, not the Clity could limit the number of off-sale <br />licenses to one and neigotiate with the liciensee to take over the lease and <br />inventory of the Roseville municipal liquor store. <br />If the City attempted to limit the number of licenses to one, it would have the <br />same effect ofestablishing an exclusive franchise, in the City. As we have seen <br />previlously, the Attorney General has given us an opinion, that such an exclusive <br />franchise would be unlawful. (See our letter dated July 28, 1981, with <br />enclosures, copies of which, are attached for your reference.) <br />Use of a single of'f-sia,le license would have the same, effect as an exclusive <br />I <br />franchise agreement, and we believe, that such an arraingement would probably be <br />ui:ni:la:w:f:ul and, perhaps, even a, violation of the anti-trust laws. <br />Yolu�rs very truly, <br />PETERSON CONVERSE <br />Roge+ooA.
