Notice to Proceed. The improvements shall be installed in accordance with City details, standards, 9 and ordinances. The plans and specifications shall be prepared by a competent registered 10 professional engineer, furnished to the City for review, and approved by the City Engineer. I 1 1. The Developer shall obtain all necessary permits from the Minnesota Pollution Control 12 Agency (MPCA , Minnesota Department of Health (MDOH)�, and other agencies before 13 proceeding with construction. Copies of these permits must be provided to the City 14 Engineer. 15 2. The Developer or his engineer shall schedule a preconstruction meeting at a mutually 16 agreeable time at City Hall with all the parties concerned, including City staff, to review 17 the program for the construction work. 18 3. The Developer represents to the City that the plat complies with all City,, County,, 19 Metropolitan,, State and Federal laws and regulations including, but not limited to.- 20 subdivision ordinances,, zoning ordinances and environmental regulations. If the City 21 determines that the plat does not comply, the City may, at its option, refuse to allow 22 construction or development work in the plat until the Developer does comply. Upon the 23 City's demand, the Developer shall cease work until there is compliance. 24 25 F. Time of Performance. The Developer shall install all required improvements enumerated in 26 Paragraph C which will serve the plat by October 15, 2011, The Developer may, however, forward 27 a request for an extension of time to the City. If an extension is granted, it shall be conditioned upon 28 updating the security posted by the Developer to reflect cost increases and the extended completion 29 date. 30 G. Inspection. The Developer shall provide the services of a Residential Project Representative and 31 assistants at the site to provide continuous observation of the Contractor's work. 32 1. The Developer shall provide the City Engineer a minimum of one business day notice 33 prior to the commencement of the underground pipe laying and service connection; and 34 prior to subgrade, gravel base and bituminous surface construction. 35 2. Developer's failure to comply with the terms of this section shall permit the City 36 Engineer to issue a stop work order which may result in a rejection of the work and 37 which shall obligate the Developer to take all reasonable steps, as directed by the City 38 Engineer to ensure that the improvements are constructed and inspected pursuant to the 39 terms of this Agreement; and shall further result in the assessment of a penalty, in an 40 amount equal to I% per occurrence, of the amount of the security required for Developer 41 improvements.
