<br />Lot 17,, lock L ROSEWOOD,, according to the recorded. plat thereof ("Easement Area");
<br />WHEREAS,, the City desires to construct and. maintain certain storm water ponding
<br />improvements and. vegetation on,, over,, across,, and. through the Easement Area and. to use the
<br />Easement Area to access adjacent land. for the purpose of construction and. maintenance of certain
<br />other storm water ponding improvements; and.
<br />WHEREAS,, the Grantor is willing to give the City the right to construct and. maintain storm
<br />water ponding improvements and. vegetation on,, over,, across and. through the Easement Area and. to
<br />give the City the right to use the Easement Area to access certain adjacent land. upon the terms and.
<br />conditions stated. herein;
<br />NOW,, THEREFORE,, in consideration of One Dollar ($,1.00) and. the mutual covenants and.
<br />agreements contained. herein,, it is agreed. as follows:
<br />1. The Grantor does hereby grant and. convey to the City and. its successors and. assigns,,
<br />a nonexclusive temporary easement for (i) the construction of storm water ponding
<br />improvements d.escribed. on Exhibit A attached. hereto,, and. the planting or installation
<br />of certain vegetation d.escribed. on Exhibit B attached. hereto,, which such exhibits are
<br />over, and. through the Easement Area-
