k" <br />REQUEST FOR COUNCIL ACTION <br />Date: 03/28/11 <br />Item No.: 13 . c <br />City Manager Approval <br />Item Description: Consider Amending City Code Chapter 302 to Allow for a Brewery and Off-Sale <br />Retailing Liquor License <br />2 City S from "Staff have received a request fr Pour Decisions Brewing Company, LLC; a prospective business <br />3 which desires to set up a small production brewery that distributes products to retail locations. As <br />4, proposed, the brewery would produce less than 3,500 barrels of malt liquor per year in accordance with <br />5 State Statute 340A.301 (Attachment B) which establishes a separate regulatory category for smaller <br />6 breweries. In an effort to build interest in their products they also seek the ability to sell their finished <br />"7 product in a retail setting. <br />9 The owners have been in contact with the City's Planning Staff to ensure that they will meet all zoning <br />110 requirements. However, the presence of an off-sale retail component triggers the need for a local liquor <br />11 license under City Code Chapter 302 (Attachment <br />12 <br />13 City Code allows for five types of liquor licenses including; on-sale, on-sale wine, club, special Sunday, <br />14, and off-sale. Currently there is not a specific category for breweries or brew pubs. As a result, the <br />15 proposed brewery would fall under the off-sale liquor license category. City Code further limits the <br />116 number of off-sale liquor licenses to a maximum often — all of which are currently in use. The applicant is <br />1 ��7 seeking a means to obtain a liquor license either through the creation of a new category for his business <br />11 111",,'11 type or by increasing the allowable off-sale licenses. <br />119 <br />2o The City Council has considered requests to increase the allowable off-sale licenses in 2005 and 2008. In <br />2 i both cases the Council chose to leave the current self-imposed limit of 10 intact. <br />22 POLICY OBJECTIVE <br />23 Although there are some State-imposed restrictions with regard to off-sale locations, municipalities have <br />24, discretion in how many liquor licenses it issues. While the City has historically limited the number of off- <br />25 sale establishments, it does not place limits on other establishments that serve alcohol. <br />27 Unlike previous requests for additional licenses geared towards traditional-type liquor stores, this request is <br />2,,, associated with a type of business that currently is not in Roseville.
