'7 1 Create processes to allow staff and Council to review and modify proposals to allow <br />'72 for the city of preserve and protect neighborhood character. The current code, like <br />'7 3 the previous code, outlines standards and requirements to be me for development or <br />'74 improvement of a property. If those standards and requirements are met, the use and/or <br />'7 5 improvement is allowed to go forward upon receiving a building permit. Certain uses, <br />'7 6 because of their nature or potential impact are only conditionally permilled and are <br />'7 "7 required to receive approval by the City Council. In addition, if a proposed use is not <br />'78 consistent with the (7omprehensive Plan or the current zoning designation, the (.,ily <br />'7 9 Council has to approve a change to the property -s designation before allowing for the <br />development or improvement. The previous code also allowed for a Planned Unit <br />Development (PUD) that allowed for de via lions from the regulations and standards due <br />to the uniqueness of the proposal. Any PUD, which in effect is the granting ofsevenal <br />variances to the code, needed to b�e approved by the City C 0 uncil. <br />Under the previous code, PUDs were used quite ftequently (and with crilic ism} for <br />development as the existing code did not allow for a lot o f 1'e ibili y and was outdated <br />with the current building and development trends and techniques. Due to the excessive <br />use of PUDs and the inherent criticism of PUDs, the new code no longer requires or <br />allows for a PUD. Instead, the new code has updated the standards and regulations to <br />, c en t building, design, and development trends and techniques. Staff believes this is a <br />90 better approach as it gives more certainly to property owners, cilizens, and developers <br />9111 on what can occur on a property and how it will occur. Since the zoning code ref flects <br />92 and implements the Comprehensive Plan goals and policies, there is less of concern of <br />93 development ofpro pie rly and less of a need' for City Council review if the proposal meets <br />94 the standards and regulations of the Zoning (7Ode. <br />95 The end result of the new code is that the City Council will now b�e seeing less <br />96 development proposals co min gf onward for their consideration and approval. City <br />97 Council approvals will still b�e required for conditional and interim uses, rezoning and <br />98 comprehensive plan amendments, and subdivision Plats. If a use is permilled and the <br />99 proposal meets all of the requirements of the zoning code (e.g. does not need a rezoning <br />or variance), the (7ity (7ouncil would notform�ally approve the project. <br />'I The (.,-Yily Council should discuss the need for their review ofpermilled projects and if <br />-1 <br />'1 2 desired whether it should he for all projects orjust certain specific projects. <br />'I ('-) 3 Review public notification policy for "aggressive land uses". Public hearing <br />104 notification of land use cases is required under state statutes. The statutes require that <br />all properly owners within 350 feet of the subjeciproperly be notified on thepublic <br />'1 6 hearing. In 2007, the (., Y ity increased that distance to 500feet. While the existing notice <br />seems to sufficefor a majority of land use cases, there are certain uses that cause <br />, c nsiderable controversy due to the lack of notice to a larger area. In checking with the <br />surrounding communities, the (.,ily of Roseville has largest notification area for land use <br />cases. If there is a desire to create a larger notification area, the (., Y ity Council should <br />discuss if it should apply to all land use public hearings orjust certain ones and how <br />112 large of a notification area it should b�e. <br />113 Evaluate High Density Residential code and create greater setbacks when adjacent <br />114 to lower density uses. When a higher density project goes next to a lower density <br />11 project, there is concern ab�out how the higher density use's mass and scale will affect the <br />116 lower density area.
