Rf- <br />REQUEST FOR COUNCIL ACTION <br />► =16,1 <br />2 <br />• The property is a single family home owned by Mr. David Battisto who lives at the property. <br />3 The City continues to receive complaints from a neighbor about an unfinished driveway that <br />1 <br />4 does not have an approved hard surface installed (as required by City Code). <br />Due to financial hardships, the property owner states he cannot complete a hard surfaced <br />driveway that was required as part of a 2008 garage addition. The garage was finished, but the <br />"7 driveway was not. Currently the driveway just has a gravel base. <br />The current violation is.- <br />9 o A driveway installed without an approved hard surface material. This is a violation ofRoseville's City <br />'10 Code,, Section 703. .B.7 which specifically requires residential driveways to be hard surfaced with <br />asphalt, concrete or pavers. <br />12 This case came before Council on August 8th, 2011. At the public hearing staff recommended <br />13 that in-order to resolve the issue before winter,, Council approve a voluntary abatement of the <br />14 violation whereby the City would contract to complete an asphalt overlay and assign the costs to <br />1 f.t the property for collection with taxes. Council did not approve the recommendation, discussed <br />1 1 possible options and then tabled the matter. <br />1 r Staff reviewed various options for brining the property into compliance, including.- <br />1 1. Issue a Ramsey County Court Citation for a City Code violation.- <br />'19 a), Advantages.- <br />20 1), This process follows existing City Code enforcement process. <br />21 2), Less staff time is devoted to a resolution. <br />22 b), Disadvantages.- <br />23 1), Could take a long time to resolve (a year or more). <br />24 2. Change Roseville's City Code to have gravel surfaced driveways included in Section <br />25 407 as public nuisances, whereby the City could then perform an abatement (contract to <br />26 complete the work), under existing process in City Code Section 407.06. <br />27 a), Advantages.- <br />28 1), Would allow for abatement of the violation to be performed under <br />29 existing City Code enforcement process in Section 407.06. <br />30 b), Disadvantages.- <br />Page I of 3 <br />
