4.0 BACKGROUND <br />The property, addressed only as 2256-2350, 2255-2275, and 2520 Highcrest Road and <br />2295 Walnut Street,, has a Comprehensive Plan designation of Industrial (1), and a zoning <br />classification of Industrial (1), District. <br />5.0 VACATION HISTORY <br />5.1 On May, 9, 1963 the predecessor in interest of the subject land granted the Village of <br />Roseville a public street easement for Highcrest Road and County Road B2 now referred <br />to as Terminal Road in that location), and which action was supported by a Warranty <br />I <br />Deed dated the same (Attachment Q. <br />5.2 On May 12, 1986, the City Council decided to abandon these two roads/streets and <br />approved the execution of a Release of Easement and Quit Claim Deed in favor of the <br />predecessor of interest. Both documents were duly executed and recorded against the <br />I <br />property with Ramsey County (Attachment D). <br />5.3 These two streets have not functioned as public streets, possibly since they were <br />established. However,, recently the Ramsey County Surveyor has indicated to Meritex <br />that the Public Road Easement of 1963 needs to be properly vacated under Minnesota <br />State Statutes 412.581. Although the attorney for Meritex disagrees with the <br />requirement, they are seeking the vacation of a road easement that the City has not <br />maintained since 1986. <br />5.4 Since the Planning Commission is responsible for holding the public hearings for <br />applications like the proposed vacation, Planning Division staff is preparing the report <br />and supporting materials for review. But Planning staff doesn't have an interest,, per se,, <br />in such proposals and merely conveys the comments and recommendation of the Public <br />Works Department in addition to coordinating the review of the proposal by the Planning <br />Commission and City Council. <br />5.5 The City of Roseville Public Works Department staff has reviewed the proposed vacation <br />of public street easements and supports the vacation, more as a housekeeping item, since <br />the City took action in 1986 to release the easement and abandon its interest as a public <br />street/roadway. <br />5.6 As of the time this report was prepared, Planning Division staff has not received <br />questions or comments about the proposal from nearby property owners. <br />6.0 PLANNING COMMISSION ACTION <br />At the duly noticed public hearing of September 7, 2011, the Roseville Planning <br />%1.11 <br />Commission voted (6-0), to recommend to the City Council approval of the vacation of <br />the two public street easements. <br />7.0 SUGGESTED CITY COUNCIL ACTION <br />ADOPT A RESOLUTION VACATION the public street easement for Highcrest Road and <br />County Road B2 (now referred to as Terminal Road),, based on the comments and <br />findings of Sections 4-6 of this staff report. <br />%1.11 <br />Prepared b y: City Planner T'homas Paschke <br />Attachments: A: Area map C: Proposed vacation <br />B: Aerial photo D: Draft Resolution <br />PF I I -024RCA092611 (3).doc <br />Page 2 of 2 <br />
