REQUEST FOR COUNCIL ACTION <br />Date: 9/26/11 <br />Item No.: 9. a <br />Department Approval City Mana er Approval <br />Item Description: Consider Ordinance Updates to the Storm Water Drainage Erosion and <br />Sedimentation Control Ordinance <br />2 On August 8, 2011, the City Council reviewed the proposed changes to the Erosion and <br />3 Sedimentation Control Ordinance. <br />4, The Public Works Environment and Transportation Commission recommends the City Council <br />5 consider adopting the updates to the Erosion and Sedimentation Control Ordinance. This <br />6 ordinance was originally adopted by the City Council on January 28, 2008. Attached is the draft <br />"7 ordinance for this discussion. <br />This ordinance will be moved out of the Zoning Code and into the Storm Water Code, <br />9 specifically 803.04. This is the same chapter as the Illicit Discharge Ordinance (803.3) and the <br />110 future location of the City's Storm Water Drainage Ordinance. The Planning Commission <br />11 reviewed this proposal at their meeting on September 7, 2011 and recommends to the City <br />12 Council that this change be made. <br />13 POLICY OBJECTIVE <br />14, The City's Comprehensive Plan and the Comprehensive Storm Water Management Plan discuss <br />15 the importance of protecting the city's water resources. This ordinance is consistent with that <br />116 objective. <br />1 "7 FINANCIAL IMPACTS <br />11 111",,'11 The adoption of this ordinance should not have a negative impact on city budgets or operations. <br />119 Erosion Control Permits Fees cover the staff time required to review and inspect these permits. <br />20 STAFF RECOMMENDATION <br />21 Staff recommends the Council consider adopting an Ordinance amending Title 8 by adding <br />22 Section 803.04 Erosion and Sedimentation Control to Chapter 803 Storm Water Drainage. <br />23 Staff recommends the Council consider approving the ordinance summary. <br />24, REQUESTED COUNCIL ACTION <br />25 Consider adopting an Ordinance amending Title 8 by adding Section 803.04 Erosion and <br />26 Sedimentation Control to Chapter 803 Storm Water Drainage. <br />27 Consider approving the ordinance summary. <br />Prepared, by: Debra Bloom, City Engineer <br />Attachments: A: Ordinance <br />B: Ordinance Summary <br />Page I of I <br />
