Mr. Lloyd noted that a large pile of rubble in northern portion of the proposed <br />45 <br />outlot had been the subject of a recent interim use approval. <br />46 <br />Staff recommended approval of the proposed PRELIMINARY PLAT, pursuant to Title 11 <br />47 <br />(Subdivisions) of City Code, as detailed in the staff report dated August 3, 2011; and <br />48 <br />conditions of Section 7. <br />49 <br />Applicant representatives were present, but had no comment. <br />50 <br />Chair Boerigter closed the Public Hearing at 6:40 p.m.; no one appeared for or against. <br />51 <br />Member Wozniak sought clarification on another FedEx proposal earlier in the year for an <br />52 <br />expansion off Terminal Road. <br />53 <br />Mr. Lloyd confirmed that there had been an earlier land use case for expansion of a <br />54 <br />FedEx facility on Terminal Road west of this project site; however, he noted that this land <br />55 <br />use was for more ground-oriented, smaller trucks, while the other use is related to air <br />56 <br />freight and involved larger semi-trailers. <br />57 <br />MOTION <br />58 <br />Member Boguszewski moved, seconded by Member Wozniak seconded, to <br />59 <br />RECOMMEND TO THE CITY COUNCIL approval of the proposed PRELIMINARY <br />60 <br />PLAT at 2285 Walnut Street; based on the comments and findings of Section 4-6 <br />61 <br />and the conditions of Section 7, as detailed in the August 3, 2011 Request for <br />62 <br />Planning Commission Action. <br />63 <br />Ayes: 6 <br />64 <br />Nays: 0 <br />65 <br />Motion carried. <br />66 <br />Chair Boerigter noted the anticipated City Council action on this item scheduled for <br />67 <br />August 22, 2011. <br />68 <br />b. PROJECT FILE 0003 <br />69 <br />Request by City Staff for approval of an ordinance creating Chapter 1022 <br />70 <br />establishing a zoning overlay district for the Twin Lakes Redevelopment Area that <br />71 <br />will govern development to ensure adequate infrastructure is constructed and <br />72 <br />appropriate environmental efforts will be undertaken consistent with the Twin <br />73 <br />Lakes Alternative Urban Area-wide Review (AUAR) and the Twin Lakes Roadway <br />74 <br />Cost Allocation Study <br />75 <br />Chair Boerigter opened the Public Hearing at 6:42 p.m. <br />76 <br />City Planner Thomas Paschke introduced City Attorney Charles Bartholdi, who provided <br />77 <br />a review of the proposed ordinance. <br />78 <br />City Attorney Bartholdi provided a background of the proposed ordinance and the Twin <br />79 <br />Lakes Redevelopment Area, with deterioration of the area in part due to deregulation in <br />80 <br />the 1950’s and consolidation of many businesses in the Twin Lakes area, or their <br />81 <br />subsequent demise. Mr. Bartholdi advised that, due to this continual degradation of the <br />82 <br />area, the City Council in 1988 designated a Twin Lakes Redevelopment Area to address <br />83 <br />its ongoing deterioration. <br />84 <br />City Attorney Bartholdi reviewed subsequent creation of an Alternative Urban Area-Wide <br />85 <br />Review (AUAR), adopted by the City Council in 2007, and its purpose as an <br />86 <br />environmental review document provided for in Minnesota State Statute to study impacts <br />87 <br />of development on numerous matters, including traffic, pollution, water quality, soils, <br />88 <br />wildlife and the natural ecosystem. Mr. Bartholdi advised that the AUAR provided <br />89 <br />mitigation plans by setting forth specific improvements and regulations to prevent <br />90 <br />adverse impacts, and in 2008, the City Council adopted the final AUAR report, an <br />91 <br />allocation study, for the purpose of establishing a cost for anticipated infrastructure costs <br />92 <br />deemed necessary by the AUAR and allocating costs equitably among parcels as <br />93 <br />development occurs, while allowing for updating those costs annually based on actual <br />94 <br /> <br />
