We have lived <br />roughly 600 feet from the proposed site for about 1,8 years,. I have read the recommendation <br />from the Planning Commission and concur with the recommendation for denial and the valid <br />points, cited. I'd further like to make note of similar cas,es, that have bearing on the one <br />under cons,ideration. <br />1. In the cas,e of Beck Vs,. the City of Raleigh NC (ruling February 1,7, 2009), a pawn shop <br />appealed the denial of permit. The appeal failed and the ruling cited that the city's, <br />adoption of a "buffer for commercial, neighborhood bus,ines,s, and shopping center" was <br />consistent with a municipality's, discretion to discharge its le is,lative functions,. <br />2. In LaGrange Illinois, the city is considering changes, to zoning ordinances, regulating <br />bus,ines,s, activities, of pawn s,hops, away from central bus,ines,s, district in the wake of an <br />outcry from down town bus,ines,s, owners, who said a pawn shop will scare away quality shoppers <br />and reduce property values,. Final disposition of new restrictions, currently has not been <br />adopted as of this writing but the protests, are shared by residential owners, as well as <br />bus,ines,s, owners, who see pawn s,hops, and their patrons, as a sign of neighborhood and business <br />environment deterioration. <br />3. Most recently in Minnesota in the cas,e of Pawn America MN LLC vs,. the City of St. Louis, <br />Park (August 26, 2010) , . the plaintiff (Pawn America) appealed and lost a cas,e wherein the <br />City adopted a restriction of pawn s,hops, locating within 350 feet of a residence (in the <br />Roseville cas,e, the nearest residence is approximately 1,00 feet., adjacent to the State Farm <br />agency). It should be noted that in the face of opposition Pawn America immediately entered <br />into a lease and submitted a signed certificate of occupancy and requested an immediate <br />issuance of a pawn brokerage licens,e.
